The Plainview City Council met on March 10, 2009 at 7:00 p.m. in the City Council
Chambers of the Plainview City Hall at 901 Broadway. The agenda for this meeting
was posted in City Hall at 3:00 p.m. on March 6, 2009. Mayor John C. Anderson
presided. Councilmembers present were: Kelvin Tipton-District 1, Cathy Waggoner-
District 2, Belinda Pena-District 3, John N. Bertsch-District 4, Ron Trusler-District 5,
Wendell Dunlap-District 6 and Roland Nash-District 7.
Staff members present were: Greg Ingham-City Manager, Mike Gilliland-Director of
Public Works, Leslie Pearce-City Attorney, Will Mull-Police Chief, Dale Simpson-
Director of Civil Service, Rusty Powers-Fire Chief, Delwin Derrick-Chief Building Official,
Eric Turner-Main Street Coordinator, Jack Keller-Budget Manager and Belinda
Hinojosa-City Secretary.
Guests Present: David Wilder, George Meriwether, Brian Pohlmeier, Angel Morren,
and Sherrie Wall

Councilmember Kelvin Tipton delivered the invocation and led in the Pledge of
Allegiance. '
Councilmember Trusler moved to adopt the consent calendar. The motion was duly
seconded by Councilmember Dunlap and carried by unanimous vote. Items approved
on the consent calendar included the approval of the minutes of February 24, 2009 and
March 5, 2009.
David Wilder presented an update on the Wee Care Project. He stated in 1990, the
Wee Care Community Project was begun. The Center has since taken over the
daycare operated by Mrs. Sams. With the expansion, they hope to increase attendance
to 450. They currently have several children on the waiting list. The construction
includes construction of four large pre-school classrooms which can be divided into
eight classrooms if necessary, a library and a gym. He stated they have $716,000
pledged and have received $436,000 of that. They have signed a $781,000 contract
with Sunset Construction. He advised that the building had been ordered and that the
inmates from the prison would be doing a lot of the work. He expressed concern with
additional assistance from the City for Yonkers Street removal of curb, sewer and water
pro rata and building permits.
Mayor Anderson thanked them for what they are doing and stated they are a vital part of
the community.
Greg Ingham, City Manager advised that the request of Mark and Robin McClanahan
for a final re-plat, of a part of Block 43 Lakeside Addition to Daffern Subdivision Lot 1,
City of Plainview, Hale County, Texas would be considered at a special meeting at noon
on Friday. The City has received all the paperwork. The Planning and Zoning
Commission did not have a quorum present at their last meeting and they will be
meeting on Thursday. The City can then act on their recommendation at the special
called meeting. He stated the City is trying to work with the McClanahan's to keep
going on construction.

George Meriwether with Williams, Meriwether, Smith Co. LLP presented the Audit for
Fiscal Year 2007-2008. He stated this was a good year for the City and that the City is
in very good financial condition. He stated there are no findings to report and the City
has received a clean report.
Mayor Anderson thanked Jack Keller and his staff and Mr. Ingham and his staff for their
work.
Mayor Anderson asked for public comment. There was no public comment.
Councilmember Tipton moved to accept the Audit for Fiscal Year 2007-2008. The
motion was duly seconded by Councilmember Pena and carried by unanimous vote.
Mayor Anderson introduced on second reading Ordinance No. 09-3512, an Ordinance
of the City of Plainview Amending the Plainview Code of Ordinances to Create Article
XXVIII of Chapter 20, Plumbing, in Order to Establish the Minimum Standards for
Installation of Irrigation Systems Within the Corporate Limits of the City And the
Extraterritorial Jurisdiction; Providing for a Criminal Penalty, Class C Misdemeanor Not
to Exceed Two Thousand Dollars ($2,000.00) for Violation of the Code, Per State Law;
Amending Chapter 20, Article X, Permits, Fees, and Inspections, Section 20-99;
Amending Chapter 20, Article XII, Conformance With Code, Section 20-131; Chapter
20, Article XII, Add the Following Exception, Section 603.3.2; Severance Clause;
Providing fora Continuation for Current Law; Repealer; Cumulativeness Clause;
Conflicts Clause; Penalty; Providing for Publication and Effective Date. Since this was
the second of two readings, the Council chose to forego the staff briefing and asked for
public comment. There was no public comment.
Councilmember Dunlap moved to approve Ordinance No. 09-3512 on second reading.
The motion was duly seconded by Councilmember Tipton. Mayor Anderson,
Councilmember Waggoner, Pena, Truster, Dunlap and Nash voted "for" the motion.
Councilmembers Tipton and Bertsch voted "against" the motion. The motion carried.
There being no further business, Mayor Anderson adjourned the meeting at 8:01 p.m.
