HomeMy WebLinkAbout09 0723 min313 CITY COUNCIL WORKSESSION MINUTES July 23, 2009 The Plainview City Council met on Thursday, July 23, 2009 at the Plainview Convention Center, 2902 West 4th Street, Plainview, Texas. The agenda for this meeting was posted in City Hall at 11:29 a.m. July 20, 2009. Mayor Anderson presided. City Council Members present were: Cathy Waggoner, District 2; Belinda Pena, District 3; John Bertsch, District 4; Ron Trusler, District 5; and Roland Nash, District 7. Staff members present were: Greg Ingham, City Manager; Leslie Pearce, City Attorney; Rusty Powers, Fire Chief; Captain Dennis Harkins, Police Department; Jack Keller, Budget Manager; Dale Simpson, Civil Services Director; and Katherine Egger, Deputy City Secretary. Visitors present: none Media Present: Tommy Young, Plainview Daily Herald Mayor Anderson called the meeting to order at 11:45 a.m. 1. Mayor Anderson led the invocation. 2. Councilmembers Kelvin Tipton and Wendell Dunlap were excused absences. 3. Budget Manager Jack Keller presented the Quarterly Investment Report. There was no public comment. Councilmember Roland Nash made the motion to approve the Report as presented. Councilmember Ron Trusler seconded the motion. Councilmember John Bertsch and Mayor Anderson commented. Mayor Anderson stated the Vote was unanimous in favor. 4. City Manager Greg Ingham stated that City Attorney Leslie Pearce has been working with Xcel attorneys and franchise attorneys on the Southwestern Public Service franchise for over a year and she is prepared to present a three minute summary. Ms. Pearce stated that this franchise has many changes from the old franchise, including the addition of an indemnity clause, adding insurance requirements, providing the non-exclusive use of right-of--way, adding the 5% franchise fee (which has been in the franchise extensions), gross receipts are detailed, audit is detailed, and more. This franchise has all the good stuff that other cities have. There was no public comment. Councilmember Ron Trusler made the motion to approve Ordinance No. 09-3514 as presented and. Mayor Anderson stated the Vote was unanimous to approve. 5. City Manager Greg Ingham reviewed the items for the July 28, 2009 City Council meeting. 6.
