HomeMy WebLinkAbout09 0917 min338 The City Council met on September 17, 2009, at the Plainview Convention Center, 2902 West 4th Street, Plainview, Texas. The agenda for this meeting was posted in City Hall at 11:15 a.m. on September 14, 2009. Mayor John C. Anderson presided. Councilmembers present were: Kelvin Tipton-District 1, Cathy Waggoner-District 2, Belinda Pena-District 3, John N. Bertsch-District 4, Ron Trusler-District 5, Wendell Dunlap-District 6 and Roland Nash-District 7. Staff members present were: Greg Ingham-City Manager, Mike Gilliland-Director of Public Works, Will Mull-Police Chief, Dale Simpson-Civil Service Director, Leslie Pearce-City Attorney, Jack Keller-Budget Manager, Rusty Powers-Fire Chief, and Belinda Hinojosa-City Secretary. News Media Present: Hayley Cox, Plainview Daily Herald Greg Ingham, City Manager presented on first reading Ordinance No. 09-03516, an Ordinance adopting and approving the Budget for the fiscal year beginning October 1, 2009 and terminating September 30, 2010, and making such appropriations for each department, project and account; severability clause; cumulativeness clause; conflicts clause; effective date. The total Budgeted Expenditures for the 2009-2010 Fiscal Year are $22,886,930 excluding the Internal Service Funds. The General Fund revenues for fiscal year ending September 30, 2010 are $11,086,690 and the General Fund Expenditures for fiscal year ending September 30, 2010 are $11,061,690. The Solid Waste Management Fund revenues for fiscal year ending September 30, 2010 are $2,804,850. The expenditures are $2,698,705 operating and $375,000 system improvement for a total of $3,073,705. The Water & Sewer Fund revenues for fiscal year ending September 30, 2010 are $5,943,500 and the expenditures are $5,115,270 in operating expenses, $781,125 in debt service and $460,000 in system improvements for a total of $6,356,395. This fund is seeing a major increase in fees to the State of Texas. There is also new debt service for the additional water wells through CRMWA. The current tax rate for Plainview is $.5685 and the proposed tax rate for 2009-2010 is $.5685. Mr. Ingham presented a slide of twelve cities with a population in the 20,000 to 25,000 range and the average tax rate for them is $.6645 which is above the City of Plainview's proposed tax rate. The proposed tax rate will raise additional property tax revenue of $11,100.00 of which $8,376.00 is from new property. Mayor Anderson asked for public comment. There was no public comment. Councilmember Tipton moved to approve Ordinance No. 09-3516 on first reading. The motion was duly seconded by Councilmember Waggoner and carried by unanimous vote. Mr. Ingham presented for consideration an action to ratify the Property Tax Increase Reflected in the FY 2009-2010 Budget. He stated this is part of the Truth in Taxation requirements brought about by the Texas Legislature which requires the Council to ratify the tax rate reflected in the budget of $.5685 per $100 valuation. Mayor Anderson asked for public comment. There was no public comment. Councilmember Trusler moved to ratify the property tax increase reflected in the budget for Fiscal Year 2009-2010. The motion was duly seconded by Councilmember Pena and carried by unanimous vote. City Council Minutes September 17, 2009 Page 1 of 4 Mr. Ingham presented for consideration on first reading Ordinance No. 09-3517, an 339 Ordinance levying municipal ad valorem taxes for the City of Plainview, Texas, for the Year 2009, and directing the assessment and collection thereof; severability clause; cumulativeness clause; conflicts clause; and effective date. The ordinance levies ad valorem tax for the year 2009. The Proposed Tax Rate for 2009-2010 is $0.5685. The Adopted Tax Rate for 2008-2009 is $0.5685 and the Effective Tax Rate for 2009-2010 is $0.5638. The proposed tax rate is an increase of 0.833629% over the effective tax rate. Mayor Anderson asked for public comment. There was no public comment. Councilmember Bertsch moved that the property tax rate be increased by the adoption of a tax rate of fifty-six and eighty-five hundredths cents ($.5685), which is effectively a 0.833629 percent increase in the tax rate. The motion was duly seconded by Councilmember Tipton and carried by unanimous vote. Mr. Ingham presented for consideration on first reading Ordinance No. 09-3518, an Ordinance of the City of Plainview, amending Chapter 25 Article II Entitled "Rates and Charges" of the Code of the City of Plainview, Texas; cumulativeness clause; conflicts clause; severability clause; and effective date. The current residential water rate for Plainview for 5,000 gallons is $19.40 and $27.35 for 10,000 gallons. The proposed rate for 5,000 gallons is $20.35 and $28.45 for 10,000 gallons. In comparison with twelve cities with a population of 20,000 to 25,000, the average water rate for 5,000 gallons is $26.75 and $43.76 for 10,000 gallons which are above the City of Plainview's proposed rates. The base rate would increase from $11.45 to $12.25 per month and the rate per thousand would increase from $1.59 to $1.62 per thousand under 25,000 gallons. The rate per thousand over 25,000 gallons will go from $1.75 to $1.79. Mayor Anderson asked for public comment. There was no public comment. Councilmember Nash moved to approve on first reading Ordinance No. 09-3518. The motion was duly seconded by Councilmember Dunlap and carried by unanimous vote. Mr. Ingham presented for consideration Ordinance No. 09-3519, an Ordinance of the City of Plainview, amending Section 25-42, entitled "Monthly Sewer Rates" of the Code of the City of Plainview, Texas; severability clause; cumulativeness clause; conflicts clause; effective date. The current residential sewer rate for Plainview for 5,000 gallons is $16.00 and $23.35 for 10,000 gallons. The proposed rate is $16.45 for 5,000 gallons and $23.95 for 10,000 gallons. In comparison with twelve cities with a population of 20,000 to 25,000, the average sewer rate for 5,000 gallons is $23.38 and $36.96 for 10,000 gallons which are also above the City of Plainview's proposed rates. The base rate would increase from $8.65 to $8.95 and the rate per thousand would increase from $1.47 to $1.50 per thousand for the first 14,000 gallons. Mayor Anderson asked for public comment. There was no public comment. Councilmember Dunlap moved to approve on first reading Ordinance No. 09-3519. The motion was duly seconded by Councilmember Pena and carried by unanimous vote. Mr. Ingham presented for consideration on first reading Ordinance No. 09-3520, an Ordinance of the City of Plainview amending Ordinance No. 08-3507 to appropriate funds in the General Fund and various revenue and capital funds pursuant to Section 5.07 (a) and (d) of the Plainview City Charter allowing for supplemental appropriations in the 2008-2009 Budget; cumulativeness clause; conflicts clause; severability clause; City Council Minutes September 17, 2009 Page 2 of 4 340 and effective date. This ordinance amends the 2008-2009 budget as follows: 1) Transfer $400,000 from General Fund to Capital Improvement Fund for items such as airport match for improvements, library building repairs, fire station, screening fence, update to comprehensive plan, I-27 access road, Chamber building and skate park; 2) Transfer $280,000 from General Fund to Equipment Replacement fund for new ambulance, athletic field mowers, pickups and laptops for police; 3) Transfer $50,000 from General Fund, S/W System Improvements and W&S System Improvements to Service Center; 4) Transfer $3,210 for city's share of JAG grant; 5) Transfer $150,000 to economic development for things such as update of Buxton study; 6) Transfer $15,000 to HOME grant to make sure we have enough funds available to complete the five homes; 7) Transfer $12,500 to Main Street to cover amount over budget; 8) Transfer $27,500 to Library for $10,000 for items requested in next year's budget to be paid out of this year's budget and to correct some issues around the stairwell which need fixing; 9) Transfer to S/W system improvements $285,965 because of fuel savings; 10)Transfer $175,000 to W&S System Improvements because of fuel savings; He also pointed out that this also authorizes the 2 %2 % one time incentive payment for employees. It is because of the commitment of our staff and employees to helping us control our costs that we have been able to strengthen the financial position of the City. Mayor Anderson asked for public comment. There was no public comment. Councilmember Truster moved to approve on first reading Ordinance No. 09-3520. The motion was duly seconded by Councilmember Tipton and carried by unanimous vote. Mr. Ingham presented for consideration on first reading Ordinance No. 09-3521, an Ordinance authorizing the issuance of "CITY OF PLAINVIEW, TEXAS, GENERAL OBLIGATION REFUNDING BONDS, SERIES 2009"; specifying the terms and features of said bonds; levying a continuing direct annual ad valorem tax for the payment of said bonds; providing for the redemption of certain outstanding obligations of the City; and resolving other matters incident and related to the issuance, sale, payment and delivery of said bonds, including the approval and execution of a Paying Agent/Registrar Agreement, a Bond Purchase Agreement and Special Escrow Agreement and the approval and distribution of an Official Statement; and providing an effective date. He stated in Texas debt issuance is handled on one reading, however, our City Attorney has noted that our Charter has a requirement that Ordinances be read twice. The ordinance before you has some blanks in it because we will not know what the final numbers are until next Tuesday. At that time, if the rates are not satisfactory, the Council has the option to not pass the ordinance on second reading. He added that we are still using the same bond counsel as in the past, Fulbright Jaworski. Mayor Anderson asked for public comment. Councilmember Dunlap moved to approve on first reading Ordinance No. 09-3521. The motion was duly seconded by Councilmember Nash. Discussion was had by the Council regarding the Ordinance. Councilmember Dunlap called for the question. Mayor Anderson asked for a vote on the matter and the motion carried by unanimous vote.
