HomeMy WebLinkAbout09 0922 min 342 The Plainview City Council met on September 22, 2009 at 7:00 p.m. in the City Council Chambers of the Plainview City Hall at 901 Broadway. The agenda for this meeting was posted in City Hall at 4:50 p.m. on September 18, 2009. Mayor John C. Anderson presided. Councilmembers present were: Kelvin Tipton- District 1, Cathy Waggoner District 2, Belinda Pena District 3, John N. Bertsch- District 4, Ron Trusler- District 5, Wendell Dunlap- District 6 and Roland Nash District 7. Staff members present were: Greg Ingham -City Manager, Mike Gilliland- Director of Public Works, Will Mull Police Chief, Dale Simpson- Director of Civil Service, Leslie Pearce -City Attorney, Rusty Powers -Fire Chief, Jack Keller- Budget Manager, Eric Turner -Main Street/CVB Coordinator and Belinda Hinojosa -City Secretary. News Media Representative: Kevin Lewis Plainview Daily Herald Guests present were: Dwain McGuire, Vince Viaille and Kristen Savant. Councilmember John N. Bertsch delivered the invocation and led in the Pledge of Allegiance. Mayor Anderson presented a Certificate to the Plainview Lions Club in recognition of their 80 Birthday. Councilmember Dunlap moved to adopt the consent calendar. The motion was duly seconded by Councilmember Tipton and carried by unanimous vote. Items approved on the consent calendar included the approval of the minutes of September 8, 2009 and September 17, 2009; approval of financial reports; approval of granting a License to Encumber Public Right of Way to Talon, L.P.E. and authorizing the Mayor to sign Texas Department of Transportation Grant for Routine Airport Maintenance Program TxDOT Project No. AM 2010 PLNVW, TxDOT CSJ No. MOO5PLNVW for airport AWOS AviMet connection fees and continued scheduled maintenance. Greg Ingham, City Manager presented for consideration on second reading Ordinance No. 09 -3516, an Ordinance adopting and approving the Budget for the fiscal year beginning October 1, 2009 and terminating September 30, 2010, and making such appropriations for each department, project and account; severability clause; cumulativeness clause; conflicts clause; effective date. The total Budgeted Expenditures for the 2009 -2010 Fiscal Year are $22,886,930 excluding the Internal Service Funds. The Budgeted Revenue for major operating funds for fiscal year ending September 30, 2010 is $19,835,040 of which 21% is property tax $4,109,600; $1,660,725 is franchise tax and $3,630,500 is water sales. The Budgeted Expenditures for the major operating funds is $19,656,790. The General Fund revenues for fiscal year ending September 30, 2010 are $11,086,690 and the General Fund Expenditures for fiscal year ending September 30, 2010 are $11,061,690. The Solid Waste Management Fund revenues for fiscal year ending September 30, 2010 are $2,804,850. The expenditures are $2,698,705 operating and $375,000 system improvement for a total of $3,073,705. The Water Sewer Fund revenues for fiscal year ending September 30, 2010 are $5,943,500 and the expenditures are $5,115,270 in operating expenses, $781,125 in debt service and $460,000 in system improvements for a total of City Council Minutes September 22, 2009 Page 1 of 5 4) Transfer $3,210 for city's share of JAG grant; 345 5) Transfer $150,000 to economic development for things such as update of Buxton study; 6) Transfer $15,000 to HOME grant to make sure we have enough funds available to complete the five homes; 7) Transfer $12,500 to Main Street to cover amount over budget; 8) Transfer $27,500 to Library for $10,000 for items requested in next year's budget to be paid out of this year's budget and to correct some issues around the stairwell which need fixing; 9) Transfer to S/W system improvements $285,965 because of fuel savings; 10)Transfer $175,000 to W &S System Improvements because of fuel savings; He also pointed out that this also authorizes the 2 1/2 one time upward pay adjustment/incentive payment for employees. It is because of the commitment of our staff and employees to helping us control our costs that we have been able to strengthen the financial position of the City. Mayor Anderson asked for public comment. There was no public comment. Councilmember Nash moved to approve on second reading Ordinance No. 09 -3520. The motion was duly seconded by Councilmember Tipton and carried by unanimous vote. Mr. Ingham presented for consideration on second reading Ordinance No. 09 -3521, an Ordinance authorizing the issuance of "CITY OF PLAINVIEW, TEXAS, GENERAL OBLIGATION REFUNDING BONDS, SERIES 2009 specifying the terms and features of said bonds; levying a continuing direct annual ad valorem tax for the payment of said bonds; providing for the redemption of certain outstanding obligations of the City; and resolving other matters incident and related to the issuance, sale, payment and delivery of said bonds, including the approval and execution of a Paying Agent/Registrar Agreement, a Bond Purchase Agreement and Special Escrow Agreement and the approval and distribution of an Official Statement; and providing an effective date. He asked Vince Viaille with Specialized Public Finance to present to Council to see if feasible to refund Certificate of Obligations. Mr. Viaille with Specialized Public Finance introduced Kristen Savant with Fulbright and Jaworski. He stated the Council asked him to look into refinancing Series 2001 Certificates of Obligation. He stated the City applied for bond rating to Standards and Poor's and the City received a AA- credit rating which a two notch upgrade. He presented a chart with the Bond Buyer's 20 Bond G.Q. Index. He stated the City qualified for bond insurance but they were however able to reach a better rate without bond insurance. He presented the Sources and Uses as follows: Source of Funds Par Amount of Bonds $6,875,000.00 Reoffering Premium $62,008.60 Original Issue Discount ($7,957.95) Accrued Interest from 9/15/2009 to 10/22/2009 $19,764.81 City Council Minutes September 22, 2009 Page 4 of 5 $6,356,395. This fund is seeing a major increase in fees to the State of Texas. There 343 is also new debt service for the additional water wells through CRMWA. The current tax rate for Plainview is $.5685 and the proposed tax rate for 2009 -2010 is $.5685. Mr. Ingham presented a slide of twelve cities with a population in the 20,000 to 25,000 range and the average tax rate for them is $.6645 which is above the City of Plainview's proposed tax rate. The proposed tax rate will raise additional property tax revenue of $11,100.00 of which $8,376.00 is from new property. Mayor Anderson asked for public comment. There was no public comment. Councilmember Trusler moved to approve on second reading Ordinance No. 09 -3516. The motion was duly seconded by Councilmember Waggoner and carried by unanimous vote. Mr. Ingham presented for consideration an action to ratify the Property Tax Increase Reflected in the FY 2009 -2010 Budget. He stated this is part of the Truth in Taxation requirements brought about by the Texas Legislature which requires the Council to ratify the tax rate reflected in the budget of $.5685 per $100 valuation. Mayor Anderson asked for public comment. There was no public comment. Councilmember Bertsch moved to ratify the property tax increase reflected in the budget for Fiscal Year 2009 -2010. The motion was duly seconded by Councilmember Dunlap and carried by unanimous vote. Mr. Ingham presented for consideration on second reading Ordinance No. 09 -3517, an Ordinance levying municipal ad valorem taxes for the City of Plainview, Texas, for the Year 2009, and directing the assessment and collection thereof; severability clause; cumulativeness clause; conflicts clause; and effective date. The ordinance levies ad valorem tax for the year 2009. The Rollback Rate for 2009 -2010 is $.06225. The Proposed Tax Rate for 2009 -2010 is $0.5685 which is the same as last year. The Effective Tax Rate for 2009 -2010 is $0.5638. The proposed tax rate is an increase of 0.833629% over the effective tax rate. Mayor Anderson asked for public comment. There was no public comment. Councilmember Dunlap moved that the property tax rate be increased by the adoption of a tax rate of fifty -six and eighty -five hundredths cents ($.5685), which is effectively a 0.833629 percent increase in the tax rate. The motion was duly seconded by Councilmember Tipton. Mr. Ingham presented for consideration on second reading Ordinance No. 09 -3518, an Ordinance of the City of Plainview, amending Chapter 25 Article II Entitled "Rates and Charges" of the Code of the City of Plainview, Texas; cumulativeness clause; conflicts clause; severability clause; and effective date. In comparison with twelve cities with a population of 20,000 to 25,000, the average water rate for 5,000 gallons is $26.75. The current rate for 5,000 gallons is $19.40 and the proposed rate for 5,000 gallons is $20.35 which is well below the average rate of the cities in the comparison. The base rate would increase from $11.45 to $12.25 per month and the rate per thousand would increase from $1.59 to $1.62 per thousand under 25,000 gallons. The rate per thousand over 25,000 gallons will go from $1.75 to $1.79. Mayor Anderson asked for public comment. There was no public comment. Councilmember Nash moved to approve on first reading Ordinance No. 09 -3518. The motion was duly seconded by Councilmember Dunlap and carried by unanimous vote. Mr. Ingham presented for consideration on second reading Ordinance No. 09 -3519, an Ordinance of the City of Plainview, amending Section 25 -42, entitled "Monthly Sewer Rates" of the Code of the City of Plainview, Texas; severability clause; cumulativeness clause; conflicts clause; effective date. In comparison with twelve cities with a population of 20,000 to 25,000, the average sewer rate for 5,000 gallons is $23.38. The City of Plainview's current rate is $16.00 for 5,000 gallons and the proposed rate is $16.45 for 5,000 gallons which are well below the average rate. The base rate would increase from $8.65 to $8.95 and the rate per thousand would increase from $1.47 to $1.50 per thousand for the first 14,000 gallons with a cap at 14,000 gallons. Mayor Anderson asked for public comment. There was no public comment. Councilmember Tipton moved to approve on second reading Ordinance No. 09 -3519. The motion was duly seconded by Councilmember Trusler and carried by unanimous vote. Mr. Ingham presented for consideration on second reading Ordinance No. 09 -3520, an Ordinance of the City of Plainview amending Ordinance No. 08 -3507 to appropriate funds in the General Fund and various revenue and capital funds pursuant to Section 5.07 (a) and (d) of the Plainview City Charter allowing for supplemental appropriations in the 2008 -2009 Budget; cumulativeness clause; conflicts clause; severability clause; and effective date. He stated the City had some revenue come in high and expenses have come in under budget and the City is in a position to transfer funds out of the General Fund. This ordinance amends the 2008 -2009 budget as follows: 1) Transfer $400,000 from General Fund to Capital Improvement Fund for items such as airport match for improvements, library building repairs, fire station, screening fence, update to comprehensive plan, 1 -27 access road, Chamber building and skate park; 2) Transfer $280,000 from General Fund to Equipment Replacement fund for new ambulance, athletic field mowers, pickups and laptops for police; 3) Transfer $50,000 from General Fund, S/W System Improvements and W &S System Improvements to Service Center; City Council Minutes September 22, 2009 Page 3 of 5 346 Total Sources $6,948,815.46 Use of Funds Total Underwriter's Discount (0.636 $43,745.56 Costs of Issuance $90,000.00 Deposit to Debt Service Fund $19,764.81 Deposit to Net Cash Escrow Fund $6,792,595.99 Rounding Amount $2,709.10 Total Uses $6,948.815.46 He stated originally he thought he could save the City around $388,000. He stated the City had done real well and the projected savings is $654,171.17, which is about $59,000 a year. The net PV benefit is 7.991%. Mayor Anderson asked for public comment. Councilmember Nash moved to adopt the Ordinance authorizing the issuance of "City of Plainview, Texas, General Obligation Refunding Bonds, Series 2009" in the aggregate principal amount of $6,875,000; providing for the redemption of the obligations being refunded and approving and authorizing the execution of a Paying Agent/Registrar Agreement, a Bond Purchase Agreement and a Special Escrow Agreement in relation to such Bonds and the approval and distribution of an Official Statement. The motion was duly seconded by Councilmember Tipton and carried by unanimous vote.
