The Plainview City Council met on October 13, 2009 at 7:00 p.m. in the City Council
Chambers of the Plainview City Hall at 901 Broadway. The agenda for this meeting
was posted in City Hall at 11:15 a.m. on October 9, 2009. Mayor John C. Anderson
presided. Councilmembers present were: Kelvin Tipton- District 1, Cathy Waggoner
District 2, Belinda Pena District 3, John N. Bertsch District 4, Ron Trusler- District 5,
Wendell Dunlap- District 6 and Roland Nash District 7.
Staff members present were: Greg Ingham -City Manager, Mike Gilliland- Director of
Public Works, Leslie Pearce -City Attorney, Rusty Reese -Parks Superintendent, Rusty
Powers -Fire Chief, Will Mull Police Chief, Dale Simpson- Director of Civil Service, Eric
Turner -Main Street/CVB Coordinator and Belinda Hinojosa -City Secretary.

Councilmember Ron Trusler delivered the invocation and led in the Pledge of
Allegiance.
Councilmember Tipton moved to adopt the consent calendar. The motion was duly
seconded by Councilmember Dunlap and carried by unanimous vote. Items approved
on the consent calendar included the approval of the minutes of September 22, 2009;
and approval of the License to Encumber Public Right -of -Way to Felipe Martinez, owner
of Arcoiris.
Rusty Reese, Parks Superintendent presented for consideration and to take necessary
action regarding purchase of two mowers through HGAC. He is requesting to purchase
two 3500 D Toro Sidewinder Mowers at a purchase price of $29,522.00 each, for a total
of $59,044.00 He stated that he can get an additional $2,022.00 discount on each if
purchased before the end of the month. This would make the total price at $55,000.00.
This would be purchased through HGAC Houston Galveston Area Council of
Governments which we have an interlocal government contract with to handle some of
our purchases. These mowers are special mowers and our local dealers do not handle
the sale of these items. These mowers would be used to maintain the sports fields.
Mayor Anderson asked for public comment. There was no public comment.
Councilmember Trusler moved to approve the purchase at the price of $55,000. The
motion was duly seconded by Councilmember Pena and carried by unanimous vote.
Greg Ingham, City Manager presented for consideration Resolution R09 -208, a
Resolution of the City Council of the City of Plainview, Texas, authorizing the filing of
energy efficient and conservation block grant applications with the State Energy
Conservation Office, a part of the Texas Comptroller's Office for assistance to the City
of Plainview, Texas; designating an authorized official and authorizing such official to
execute all documents necessary; and pledging compliance to the awarded grant
program. He stated many of the larger cities and counties across the State received a
direct allocation of Federal Department of Energy (DOE) Funds through the American
Recovery and Reinvestment Act (ARRA) of 2009. The Department of Energy then gave

the State of Texas $45 million in block grant funds that were to be distributed to the
1,127 cities and 244 counties that did not receive a direct allocation. The State Energy
Conservation Office (SECO), a part of the State Comptroller's Office decided to allocate
these funds based on population rather than a competitive program. It is currently
anticipated that the City of Plainview may be eligible for $75,000.
The City will have to develop a project that will improve energy efficiency and reduce
energy use in our community. The first step in obtaining these funds is to provide the
SECO with a Notice of Intent that the City plans to accept the funds. The second step is
to provide a Resolution from the Council sayinskthat we intend to submit an application.
In order for the State to actually provide us with the application so that we can start the
process of developing a project and completing the application, we must submit the
Resolution. He stated I am asking the Council to pass this resolution to accept the
dollars given and authorize the Mayor to sign the necessary paperwork.
Mayor Anderson asked for public comment. There was no public comment.
Councilmember Trusler moved to approve Resolution R09 -208. The motion was duly
seconded by Councilmember Waggoner and carried by unanimous vote.
Mike Gilliland, Director of Public Works presented for consideration Ordinance No. 09-
3522 on first reading, an Ordinance of the City of Plainview, Texas, Hale County, Texas,
granting Atmos Energy a communication tower in accordance with Section 8:37 Radio,
Television and Microwave Towers Regulations of the Zoning Ordinances 89 -2798, 99-
3223 and 03 -3386; Requiring Atmos Energy to post a bond for the anticipated cost of
removal of such tower upon abandonment of such tower; cumulativeness clause;
conflict clause; severability clause; and effective date. He stated this tower is for the
Atmos Energy building being constructed at SW 3 and 1 -27. The property is zoned
appropriately and meets the set back requirements. The tower will be erected by South
Plains Communications and the City has received the building permit. City Code
requires that the company installing a tower post a bond to assure that the tower can be
taken down in the future if it ceases to be used. After discussions with the tower
company, staff is recommending that the bond of $3,000 be set and recommends
approval of this ordinance.
Mayor Anderson asked for public comment. There was no public comment.
Councilmember Dunlap moved to approve Ordinance No. 09 -3522 on first reading. The
motion was duly seconded by Councilmember Tipton and carried by unanimous vote.
Mayor Anderson moved to go into closed meeting to deliberate the appointment,
employment, evaluation, reassignment, duties, discipline or dismissal of a public officer
or employee, or to hear a complaint or charge against an officer or employee. [Tex.
Gov't. Code, Section 551.074]. Consider Nominees to Hale County Appraisal
Board. The motion was duly seconded by Councilmember Dunlap and carried by
unanimous vote. Mayor Anderson recessed the meeting at 7:20 p.m.
Mayor Anderson called the meeting back in open session at 7:27 p.m.
Mayor Anderson moved to nominate Buddy McGehee to serve for the City of Plainview
on the Hale County Appraisal District Board. The motion was duly seconded by

Councilmember Dunlap. Mayor Anderson asked for public comment. There was no 349
public comment. The motion carried unanimously.
There •eing no further business, Mayor Anderson adjourned the meeting at 7:29 p.m.
