HomeMy WebLinkAbout01 0724 minThe Plainview City Council met on July 24, 2001, at 7:00 p.m. in the Council Chambers of Plainview City Hall, 901 Broadway. The Council met in pre-session at 6:30 p.m. The agenda for this meeting was posted at City Hall at 9:30 a.m. on July 17, 2001. The agenda addendum was posted at City Hall at 8:30 a.m. on July 19, 2001. Mayor Lloyd C. Woods presided. Councilmembers present were: Sam Parker-District 1; Mary Jane Shanes-District 2; Rey Rosas-District 3; Ross Owen-District 5; Buddy McGehee-District 6; and Irene Favila-District 7. Councilmembers absent were Mike Hutcherson-District 4. Staff present were: James P. Jeffers-City Manager; John Berry-Director of Public Works; John Castro-Director of Community Development; Gary Glass-Fire Chief; Wally Hatch- City Attorney; Pat Hernandez-Municipal Court Judge; Norman Huggins-Director of Finance; William Mull-Chief of Police; Dale Simpson-Director of Civil Service; Matthew Tsakanikas-Main Street Coordinator and Belinda Hinojosa-City Secretary. News media representative present were: John Gunning-Plainview Daily Herald Guests present were: Huggins. Barbara Strain, Willie Strain, and guests and family of Norman Councilmember Rosas delivered the invocation. The Police Department Honor Guard led in the Pledge of Allegiance. Norman E. Huggins, Director of Finance was recognized for his 30 years of service to the City of Plainview. He will be retiring on July 27, 2001. Letters of thanks and certificates were presented to Mr. Huggins from Senator Duncan, Senator Hutchison, Senator Phil Gramm, Speaker James E. Laney, Congressman Thornberry, Governor Rick Perry, and President George W. Bush. Councilmember Owen moved that the Finance Building be called the "Norman E. Huggins Building." The motion duly seconded by Councilmember Rosas carried by unanimous vote. Mr. Huggins was then presented with a plaque in his honor to be hung at the Finance Building. A Certificate of Appreciation was presented to the Youth Invasion Center on its two-year anniversary. Councilmember Rosas advised that the Fiesta Campesina would be July 29, 2001 at Broadway Park. It is dedicated to recognizing the contributions farm workers make to the Plainview community and its surrounding areas. Sam Parker, City Councilman, District 1 issued a proclamation to his son David Dayyan Parker as a welcome back to Plainview. Chief Mull presented certificates and service award pins to Lt. Lonnie Burton for 25 years of service, Libby Delgado for 10 years of service, Frank Lara for 5 years of service and Mike Williams for 5 years of service. At 7:55 p.m., Mayor Woods called a ten-minute recess. The Council reconvened at 8:05 p.m. Councilmember McGehee moved that the Consent Calendar be approved as presented. City of Plainview City Council Minutes July 24, 2001 Page 1 of 3 The motion, duly seconded by Councilmember Favila, carried by unanimous vote. Items approved on the Consent Calendar included: approval of the Minutes of July 10, 2001; receipt of departmental reports; approval of expenditures; and granting of an excused absence for this meeting to Councilmember Hutcherson. One bid was received for the vehicle emission system. The bid was from Air Cleaning Technologies, Inc. of Broken Arrow, Oklahoma in the amount of $16,470. The addition of a third drop was requested at a cost of $5,585 and ventilation fans for the Quincy Station at a cost of $3,736, for a total cost of $25,791. The Council approved the awarding of the bid to Air Cleaning Technologies, Inc. for a total cost of $25,791. The Council approved upon second reading Ordinance No. 01-3293, an Ordinance of the City of Plainview, Texas, amending SeCtion 2, Definitions and Section 6, General Provisions, of the Plainview Subdivision Ordinance No. 89-2807; street descriptions; severability clause; cumulativeness clause; conflicts clause; effective date. This is basically a housekeeping procedure; nothing has been changed other than to more clearly define street descriptions as recommended by the Planning & Zoning Commission. Mr. Castro presented Ordinance No. 01-3292 for second reading. It amends the zoning map of the City of Plainview by issuance of a specific use permit to operate a retail tire sales store (no outside storage) in a commercial retail (C-2) district said parcel of land being Lots 3 & 4, Unit No 2, West End Addition, the same being 1100 N 1-27; cumulativeness clause; conflicts clause; severability clause; and effective date. The application was made by Rudd Owen on behalf of William S. Strain. Mayor Woods moved that Ordinance No. 01-3292 be approved on second reading. The motion duly seconded by Rey Rosas, carded by unanimous vote. Paul Reynozo presented the recommendation of the Districting Commission. He stated the Commission had looked at three plans. Plan 1 was the only completed plan, which made the most sense and still kept in line with the requirements. He stated Plan 1 called for Districts 1, 2, 3, and 7 to be predominately Hispanic with the range being anywhere from 62% to 70%. Districts 4, 5 and 6 would be predominately Anglo with the range anywhere from 59% to 80%. He also stated that there was a slight loss of Blacks in Precincts 1, 2, 3, 4, 6 and 7. There were no public comments. Councilmember Rosas moved that the City accept the recommendation of the Districting Commission and adopt upon first reading Ordinance No. 01-3295 of the City Council of the City of Plainview, Texas, pursuant to the City Charter, and in compliance with Chapter 42, United States Code, 1973C, Et Seq, adopting reformed political boundaries for the seven (7) city council districts and approving the creation of revised city election districts within said City. The motion duly seconded by Councilmember Favila, carried by unanimous vote. Councilmember McGehee expressed a sincere thanks to the Districting Commission for their work. Mr. Jeffers presented upon first reading Ordinance No. 01-3296 authorizing city administration to waive water tap and permit fees at the direction of the City Manager for non-profit organizations promoting affordable housing. He stated this was primarily for the use of Habitat for Humanity who will soon begin construction of its second home. Upon .passage of this Ordinance the City Manager would be able to waive utility tapping fees, building inspection fees and to forego monthly service charge for water, sewer and sanitation during the construction phase of Habitat for up to six months. The approximate total participation amount is about $600.00. Randy Warrick of 2800 W. 21st stated that Habitat has purchased two lots at $500,00 each from the Housing Authority. He stated they would soon begin construction west of the current Habitat house. He stated the 229 City of Plainview City Council Minutes July 24, 2001 Page 2 of 3 guidelines for qualification are $14,000 or less in income, which is 25% of the median income of the area, you have to help build the home or provide administrative assistance (such as fill out paperwork, applications etc.). Habitat carries the note and the payback is used to reimburse for the building of other houses. He stated if anyone would like to help they would appreciate the help. He stated the contact person is Drew Travis at First Presbyterian Church. Councilmember Favila moved that Ordinance No. 01-3296 be adopted upon first reading. The motion duly seconded by Councilmember McGehee carried by unanimous vote. Chief Mull presented upon first reading Ordinance No. 01-3294 amending Ordinance No. 00-3267 to transfer funds from the federal shared seizure income fund to account~ 40 of the general fund. Said funds to be applied to a matching grant with U.S. Justice Department for purchase of police equipment; cumulativeness clause; conflicts clause; severability clause; and effective date, He stated they had applied for a $32,308.00 grant. 90% would come from the Justice Department. The City's portion would be $3,590.00. $35,898.00 would be moved to the seizure fund to purchase motor vehicle equipment such as digital cameras and video cameras. Councilmember Shanes moved that the City adopt upon first reading Ordinance No. 01-3294. The motion duly seconded by Councilmember Rosas carried by unanimous vote.
