AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
PLAINVIEW, TEXAS, PURSUANT TO THE CITY CHARTER, AND
IN COMPLIANCE WITH CHAPTER 42, UNITED STATE CODE,
1973C, ET SEQ, ADOPTING REFORMED POLITICAL
BOUNDARIES FOR THE SEVEN (7) CITY COUNCIL DISTRICTS,
AND 'APPROVING THE CREATION OF REVISED CITY
ELECTION DISTRICTS WITHIN SAID CITY.
WHEREAS, the 2000 federal decennial census was conducted on or
about April 1, 2000; and
WHEREAS, final state and preliminary city populations were certified to
the President on or about January 1, 2001; and
WHEREAS, final city population figures were certified to the Texas
Legislature on or about April 1, 2001; and
WHEREAS, on or about July 15, 2001, the Secretary of Commerce
declined to adjust population figures contained in the 2000 Census, thereby
rendering the prior certification of April 1,2001 as final for all purposes; and
WHEREAS, Article III, § 28 of the Texas Constitution requires the
legislature of the State of Texas to redistrict the State Legislature during the first
regular session after publication of the decennial census; and
WHEREAS, the'
reapportionment of the
decennial census; and
United State Constitution, Article I, § 2 requires
United States congressional districts following the
WHEREAS, pursuant to the requirements of the City Charter of the City of
Plainview requires periodic reapportionment of its city districts in the belief that
fair and equal government requires reapportionment following each federal
census of the seven city districts, and modification of the resulting election
precincts contained within the geographical confines of the City of Plainview; and
WHEREAS, the State of Texas is subject to the federal Voting Rights Act
of 1965, (42 U.S.C. 1973c), as amended; and
WHERAS, such Voting Rights Act is applicable to the city Council of the
City of Plainview, and to any changes in the standards, practices or procedures
applied to all such related city districts and/or election precincts; and

WHEREAS, in effecting the process of reapportionment, the application of
numerous federal and state constitutional, statutory, and case law requirements
must be considered; and
WHEREAS, it is the express intent of the city council of the City of
Plainview, Texas to fully comply with all legal requirements for the
reapportionment of its respective city districts, together with any incident election
precincts contained within said City; and
WHEREAS, it is the express intent of the City Council of the City of
Plainview, Texas that each resident of the City of Plainview have equal access to
all political institutions of this City, State, and Nation; and
WHEREAS, in order to achieve this stated goal, reapportionment of the
various City Council districts and the various election precincts within the City of
Plainview appeared, after careful assessment, to be required;
On the 14th day of August, 2001, the City Council for the City of Plainview,
Texas met in regular session, having posted notice in compliance with Chapter
551 of the Texas Government Code.
The City Council of the City of Plainview has previously retained the firm
of Allison, Bass & Associates, LLP, of Austin, Texas, to conduct an Initial
Assessment of existing political boundaries of the City of Plainview following the
issuance of census data by the United States Census Bureau on March 12,
2001. Attached to this Ordinance, and incorporated herein for all purposes by
reference, is a copy of the initial assessment conducted by Allison, Bass &
Associates, LLP. This assessment is based upon PL94-171 data, as required by
federal law, and is further based upon information provided to Allison, Bass &
Associates, LLP by the Texas Legislative Council and by the City of Plainview.
Based upon this information, Plainview has a total maximum deviation of
23.04%. The term total maximum deviation is determined by dividing the total
population of Plainview by seven, the number of City Council districts to
determine an ideal ward size. The actual population of each district is then
determined, based upon the official population data contained within the census
count, as defined by Public Law 94-t71. The actual population of each district is
compared to the ideal district size, and a range of deviation by percentage is
determined. The range between the largest population by distdct and the
smallest population by district is determined. Any total maximum deviation in
excess of ten percent (10%) is presumptively unconstitutional under established
federal law.
As a result of this determination, Plainview has a constitutional duty to
redistrict it's political boundaries so as to achieve "One-Person-One-Vote"
numerical balance between the seven City Council districts, within permissible

lawful limitations, and simultaneously, complying with the Voting Rights Act and
applicable state and federal law.
NOW THEREFORE THE CITY OF PLAINVIEW HEREBY ORDAINS that
the City Council of Plainview, Texas, finding a clear legal duty exists to redistrict
the existing political boundaries of the City of Plainview in such a manner as to
comply with applicable state and federal law, the City Council hereby enters the
following findings of fact and of law:
Plainview has a total maximum deviation, as defined in this order,
of 23.04%.
2. Any total maximum deviation in excess of ten (10%) is
presumptively unconstitutional under federal law.
As a result, redistricting of existing political boundaries for the
present City Council districts is legally required.
City of Plainview, acting by and through it's City Council, is hereby
resolved to immediately undertake such necessary and appropriate
action to accomplish redistricting of existing City Council districts,
and any incidental modification of either existing, consolidated, or
newly created election districts necessary to accomplish such
redistricting.
The City Council shall henceforth convene in open meetings, duly
posted in accordance with the Texas Open Meetings Act, to take up
and consider one or more alternative plans for the legal redistricting
of'the City of Plainview.
After due consideration of one or more alternative plans, the City
Council shall adopt a plan deemed to satisfy legal requirements,
and which best suits the legitimate governmental needs of the City
of Plainview.
Such plan shall, after adoption, be submitted to the United States
Department of Justice for review as required by 42 U.S.C. § 1973,
otherwise known as the Voting Rights Act.
Only upon pre-clearance shall such plan, or a plan subsequently
modified to obtain pre-clearance, be implement for elections in the
year 2002 and thereafter, or until a suitable substitute has been
lawfully adopted.
Be it remembered, that on the 14th day of August, 2001, came on to be
considered the issue of periodic redistricting of city political boundaries. This
Ordinance No. 01-3295 Findings of Fact and Order Adopting Redistricting Plan Page 3 of 5
Council has, in due time, given deliberate consideration to the legal issues and
governmental duties imposed by state and federal law.
The City Council has commissioned and has received an Initial
Assessment by qualified professionals experienced in the field of redistricting law
for the purpose of making a preliminary determinatiOn of population distribution
between the seven City Council Districts, and the obligation to comply with "one-
person-one-vote" balance as required by applicable state and federal law. This
assessment has been noted in the minutes, and is incorporated by this
reference. A finding, based upon this assessment, recognized the legal duty to
redraw political boundaries to comply with applicable law, and a copy of this
finding has been entered into the city records, by which reference this prior
finding is incorporated into this Ordinance of the City Council.
After convening a Public Hearing for comment upon any and all proposed
plans, and after meeting in open session for the purpose of considering
alternatives available to the City for modification of existing political boundaries in
a manner designed to achieve both acceptable levels of numerical balance
between the seven City Council Districts, and to protect the voting rights of all
residents of the City of Plainview, the City Council has determined to adopt the
redistricting plan attached to this Ordinance in map and data form.
NOW THEREFORE THE CITY OF PLAINVIEW HEREBY FURTHER
ORDAINS that the Redistricting Plan depicted in the maps and data attached to
this Order are hereby APPROVED and ADOPTED by the City Council of City of
Plainview, Texas. Upon final approval of the supplemental data to be provided at
a later date, a submission of this plan, along with supporting maps, charts and/or
data, will be made to the United States Department of Justice pursuant to
Section 5 of the Voting Rights Act of 1964, 42 U.S.C. {}1973. This Redistricting
Plan adopted by this Ordinance shall be effective, subject to Department of
Justice preclearance, on August 14, 2001, and for all subsequent elections until
changed or modified by later Ordinance. It is expressly understood that
implementation of this plan shall not take place until the receipt of preclearance
approval by the United States Department of Justice.

Public Law 94-171 required that all voter tabulation districts (VTDsl follow census block boundaries, in many cases, county voting districts had been
drawn in a manner which did not follow a gensus block boundary. This required the State of Texas. acting tn conjunction with the State Data Center
and the Texas Legislative Council to move the actual voting district boundary to coincide with a nearby census block boundary for tabulation purposes
only. The resulting VTD was no longer "actual", but an approximation of'thc voting district referred to as a "pseudo voting district."
