ORDINANCE NO. 93-2958
AN ORDINANCE OF THE CITY OF PLAINVIEW, TEXAS, AMENDING SECTION
23-168 OF THE CODE OF ORDINANCES IgITH REGARD TO THE MAXIMUM
RATE OF SPEED FOR VI~HICLES TRAVEr.ING ON FIFTH STREET (U. S. 70);
AMENDING SECTION 23-170 (C) TO RIi~MOVE' SCHOOL ZONE DESIGNATION
ON QUINCY STREET; PROVIDING FOR A PENALTY; CUMULATIVENESS
CLAUSE; CONFLICTS CLAUSE; SI,]VERABILITY CLAUSE; AND EFFECTIVl~
DATE.
¥~HERF~S, the City Council of the City of Plainview, upon the basis of
engineering and traffic investigation, finds it necessary to amend maximum speed
limits on Fifth Street (U.S. 70) within 'the corporate limits of the City of Plainview,
Texas; and
WHERF_~kS, the City Council finds it in the best interest of the public safety
of the citizens of the City of Plainview to amend § 23-168 to reflect these changes;
and
WHRRF~kS, the City Council recognizes a need to amend § 23-170(c) of the
Code of Ordinances to delete the school zone designation on Quincy Street between
14th and 15th Streets (High School) in light of the fact that the signs have been
removed;
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of
Plainview, Texas that:

Section II
§ 23-170 be amended to delete 25 MPH school zone designation for:
The portion of Quincy Street between 14th and 15th Streets (High School).
Section III
Any person who shall violate or fail to comply with the provision of this ordinance
shall be deemed guilty of a misdemeanor and upon conviction thereof, shall be
punished by a fine of not less than $1.00 and not more than $200.00.
Section IV
Provisions of this ordinance are cumulative and nothing herein shall prevent, alter,
or diminish the applicability or enforcement of other ordinances restricting,
regulating or governing the subject matter herein.
Section V
All ordinances or portions of any ordinance of the City of Plainview, Texas in
conflict herewith, are hereby amended to conform with the provisions hereof.
Section VI
Should any section, subsection, or any portion hereof be deemed invalid for any
reason, such holding shall not render or invalidate any other section, sub-section,
sentence, provision, clause, phrase, or word severable therefrom and the same shall
be deemed severable for this purpose.
Section VII
This ordinance sBRll be of full force and effect upon its passage and publication as
required by law.
