ORDINANCE NO. 93-2960
AN ORDINANCE AMENDING THE ZONING MAP OF THE
CITY OF PLAINVIEW, TEXAS TO REZONE PROPERTY
LOCATED GENER~TJ.Y ON THE EAST SIDE OF NORTH
QUINCY STREET, NORTH OF 33RD STREET FROM A C-3,
COMMERCIAL GENERAL BUSINESS: DISTRICT, AND AN
MF-2, MULTI-FAM~Y DISTRICT - 2, TO AN MF-1,
I~JLTI-FAMILY DISTRICT - 1; CUMUI~T~SS
CLAUSE; CONFLICTS CLAUSE; SEVERABILITY CLAUSE;
AND EFFECTIVE DATE.
WHERF~S, Ordinance No. 89-2798, known as the City of Plainview Zoning
Ordinance, sets forth in Section 5 the requirements for amending the zoning map of
the City of Plainview, Texas; and
WHERF~S, Marianna Schreeder on behalf of T. C. Wall has requested that
property located generally on the East side of North Quincy Street, North of 33rd
Street be rezoned from a C-3, Commercial General Business District, and an MF-2,
Multi-Family District - 2, to an MF-1, Multi-Family District - 1; and
WHEREAS, notice of a public hearing to discuss said rezoning was published
in the Plainview Daily Herald before the 15th day prior to the hearing date; and
WHEREAS, said hearing was held in the Council Chambers of the City Hall,
Plalnview, Texas, at which time persons appeared in support of the proposal; and
WHEREAS, the proposed rezoning, as hereinafter made, has been duly
presented to the Planning and Zoning Commission for its recommendation which was
received by the City Council; and
WHEREAS, it was determined by the City Council that it would be in the best
public interest to rezone the property as' described below in the manner hereinafter
set forth in the body of this Ordinance; ~ '
NOW, THEREFORE, BE IT ORDAINED, by the City Council of the City of
Plainview, Texas that:
SECTION I
The request of Marianna Schreeder on behalf of T. C. Wall to rezone from a
C-3, Commercial General Business District, and an MF-2, Multi-Family District - 2,
to an MF-1, Multi-Family District - I a Parcel of property being a 6 acre tract out of
the Northwest part of the South half of the Northwest quarter of Survey No. 38,
Block JK-2, Hale County, Texas and described as follows:
BEGINNING at a 3/8" rodin the east right'of-way line of Quincy Street and
North line of the South half of the Northwest quarter of said Survey 38, Block
JK-2 said rod being 37.5 feet S,89°50'55"E of the northwest corner of the
South half of the Northwest quarter of said Survey;
THENCE S.89°50'55"E. 630 feet along the North line of the South ball of said
survey to a point;

THENCE S. 0°02'40"W. 414.86 feet parallel with the West line of said survey to
a point;
THENCE N. 89°50'55"W. 630 feet parallel with the North line of the South
of said survey to a point in the East right-of-way of Quincy Street;
THENCE N.0°02'40"E. 414.86 feet along the East right-of-way line of Quincy
Street, 37.5 feet East and parallel tothe West line of said Survey to the POINT
OF BEGINNING and generally located on the East side of Quincy Street North
of 33rd Street.
is hereby granted.
SECTION II
Provisions of this ordinance are cumulative and nothing herein shall prevent,
alter, or diminish the applicability or enforcement of other ordinances restricting,
regulating or governing the subject matter herein.
SECTION III
All ordinances or portions of any ordinance of the City of Plainview, Texas in
conflict herewith, are hereby amended to conform with the provisions hereof.
SECTION IV
Should any section, subsection, or any portion hereof be deemed invalid for
any reason, such holding shall not render or invalidate any other section, sub-
section, sentence, provision, clause, phrase, or word severable therefrom and the
same shall be deemed severable for this purpose.
SECTION V
This ordinance shall be of full force and effect upon its passage and
publication as required by law.
