HomeMy WebLinkAbout93-296150 ~ ZONING ORDINANCE -Zone Csse 609 R-1 to MF-1 ORDINANCE NO. 93-2961 AN ORDINANCE AMENDING THE ZONING MAP OF THE CITY OF PLAINVIEW, TEXAS TO REZONE PROPERTY LOCATED GENER.~IJ.Y ON THE SOUTH SIDE OF DIMMITT ROAD, WEST OF ENNIS FROM AN.R-l, SINGLE FAMr[.Y RESIDENTIAL DISTRICT - 1, TO AN MF-1, MULTI- FAMILY DISTRICT- 1; C~TIVENESS CLAUSE; CONFLICTS CLAUSE; SEVERABILITY CLAUSE; AND EFFECTIVE DATE. WHEREAS, Ordinance No. 89-2798, known as the City of Plainview Zoning Ordinance, sets forth in Section 5 the requirements for amending the zoning map of the City of Plainview, Texas; and WHEREAS, Marianna Schreeder on behalf of Bettye R. Cannon has requested that property located generally on the South side of Dimm~tt Road, West of Ennis be rezoned from an R-1, Single Family Residential District - 1, to an MF-1, Multi-Family District - 1; and WHEREAS, notice of a public hearing to discuss said rezoning was published in the Plainview Daily Herald before the 15th day prior to the hearing date; and WHEREAS, said hearing was. held in the Council Chambers of the City Hall, Plainview, Texas, at which time persons appeared in support of the proposal; and WHEREAS, the proposed rezoning, as hereinafter made, has been duly presented to the Planning and Zoning CommisSion for its recommendation which was received by the City Council; and WHEREAS, it was determined by the City Council that it would be in the best public interest to rezone the property as described below in the manner hereinafter set forth in the body of this Ordinance; NOW, THEREFORE, BE IT ORDAINED, by the City Council of the City of Plainview, Texas that: SECTION I The request of Marianna Schreeder on behalf of Bettye R. Cannon to rezone from an R-l, Single Family Residential District, to an MF-1, Multi-Family District, a parcel of property being a 4 acre tract out of the east part of Survey No. 26, Block JK-2, Hale County, Texas and described as follows: COMMENCING at the southeast corner of Survey No. 26, Block JK-2, Hale County Texas; THENCE North 3419.0 feet along the east line of said survey to the south right-of-way line of State Highway NO. 194 (Dimmitt Road); THENCE N.61°13.9'W. 360 feet-to the northwest corner of a 14.57 acre tract and the POINT OF BEGINNING of the herein described 4 acre tract; Page 1 of 2 51 THENCE S. 28°46. I'W. 535 feet along the west line of said 14.57 acre tract to a projection of the north line of a 20 foot wide utility easement; THENCE N. 61°13.9'W. 325.68 feet along said projection and the north line of said easement to a point; THENCE N. 28°46. I'E. 535 feet to a point in the south right-of-way line of said highway; THENCE S.61°I3.9'E. 325.68 feet along the south right-of-way line of said highway to the POINT OF BEGINNING and generally located on the South side of Dimmitt Road West of Ennis. is hereby granted. SECTION II Provisions of this ordinance are cumulative and nothing herein shall prevent, alter, or diminish the applicability or enforcement of off, er ordinances restricting, regulating or governing the subject matter herein. SECTION III All ordinances or portions of any ordinance of the City of Plainview, Texas in conflict herewith, are hereby amended to conform with the provisions hereof. SECTION IV Should any section, subsection, or any portion hereof be, deemed invalid for any reason, such holding shall not render or invalidate any other section, sub- section, sentence, provision, clause, phrase, or word severable therefrom and the same shall be deemed severable for this purpose. SECTION V This ordinance shall be of full force and effect upon its passage and publication as required by law. PASSED AND APPROVED this the 22nd day of June, 1993. ./~ ~ ~ ~ E.V.
