Amendment - Ambulance Rates
ORDINANCE NO. 93-2964
AN ORDINANCE OF THE CITY OF PLAINVIE~, TEXAS AMENDING
CHAPTER FOUR, "AMB~CES" OF THE CODE OF ORDINANCES OF
THE CITY OF YLAINVIEW, TEXAS, REGARDING AMB~CE RATES;
SEVERABILITY CLAUSE; CUMIH~TIVENESS CLAUSE; CONFLICTS
CLAUSE; EFFECTIVE DATE; AND PUBLICATION CLAUSE.
WHEREAS, the City of Plainview, Texas, by and through its City Council has the
authority to govern and regulate the permitted uses of its streets and public ways;
and
WHEREAS, the City of Plainview, Texas, has the right, duty and obligation to
protect and regulate ambulance services occurring within its corporate limits, as
such are governmental functions of as set forth in § 101.0215 (2) of the Civil Practice
and Remedies Code; and
WHEREAS, the Plainview City Code, § 4-3, "Rates", currently sets that maximum
rates which may be charged by an ambulance service operating within the corporate
limits of the City of Plainview pursuant to a franchise; and
WHEREAS, the City Council of the City of Plainview, Texas, has determined,
after reviewing and hearing the evidence, that an increase in the allowable rates is
in the best interest of the City of Plainview and its citizens;
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of
Plainview, Texas that § 4-3, Chapter 4, "Ambulances, of the Code of Ordinances of
the City of Plainview, Texas, is her~eby amended to read as follows:
SECTION I.
Sec. 4-3. Rates.
A) Non-emergency Base Rate (BLS)
$150.00
B) Emergency Base Rate (ALS), including $225.00
the following:
1. Emergency Run (Code 3)
2. Emergency Run (Code 3-Code 1)
3. Night Call
4. Intubation
5. IV Therapy
6. Cardiac Monitor
C) Oxygen
$ 20.00
D)
Mileage, from station to patient
point of destination
$ 3.00/mile
E) Mileage for return trip (patient mi]e)

Waiting Time
(no charge for first 30 minutes)

SECTION II.
If any section, subsection, sentence, clause, phrase, of portion of this ordinance
is, for any reason, held invalid or unconstitutional by any court of competent
jurisdiction, such portion shall be deemed a separate, distinct, and independent
provision and such holding shall not affect the validity of the remaining provisions
thereof.
SECTION III.
Provisions of this ordinance are cumulative and nothing herein shall prevent, alter,
or diminish the applicability or enforcement of other ordinances restricting,
regulating, or governing the subject matter herein.
SECTION IV.
All ordinances or portion of any ordinance of the City of Plainview, Texas, in
conflict herewith, are hereby amended to conform with the provisions hereof.
SECTION V.
This ordinance shall be of full force and effect upon its passage and pUblication in
the Plainview Daily Herald twice within a ten (10) day period.
