HomeMy WebLinkAbout94-2983105 Boards, Committees and Commissions ORDINANCE NO. 94-2983 AN ORDINANCE OF THE CITY OF PLAINVIEW, TEXAS ESTABLISHING A UNIFORM POLICY FOR THE MAXIMUM NUMBER OF TERMS FOR MEMBERS OF ALL BOARDS, COMMITTEES AND COMMISSIONS APPOINTED BY THE CITY COUNCIL; SEVERABILITY CLAUSE; CUMULATIVENESS CLAUSE; CONFLICTS CLAUSE; AND EFFECTIVE DATE. WHEREAS, the City Council of Plainview, Texas has noted that there exists a need to remove any limit on the number of terms members of council-appointed boards, committees and commissions may serve; and WHEREAS, the City Council desires that a uniform policy be established in order that members may serve as many consecutive terms as they are appointed to by the City Council; NOW THEREFORE, BE IT ORDAINED, by the City Council of the City of Plainview Texas that: SECTION I. Sections 9-46(c), 14-20(a), 19-20(a), 2-298, of the Plainview Code of Ordinances, §§ 37:1(7) and 38:1(7) of the Zoning Ordinance, and § 8.1.6 of the Plainview Plumbing Code and the policy for all other members of boards, committees and commissions appointed by the City Council shall be as follows: Maximum Number of Terms There shall be no limit on the number of terms a member may serve, provided the member is reappointed by the City Council. SECTION II. Should any section, subsection, or any portion hereof be deemed invalid for any reason, such holding shall not render or invalidate any other section, sub-section, sentence, provision, clause, phrase, or word severable therefrom and the same shall be deemed severable for this purpose. 106 SECTION III. Provisions of this ordinance are cumulative and nothing herein shall prevent, alter, or diminish the applicability or enforcement of other ordinances restricting, regulating or governing the subject matter herein. SECTION IV. All ordinances or portions of any ordinance of the City of Plainview, Texas in conflict herewith, are hereby amended to conform with the provisions hereof. SECTION V This ordinance shall be of full force and effect upon its passage. PASSED AND APPROVED this 11th day of January, 1994. E.V.
