ORDINANCE NO. 94-2992
AN ORDINANCE AMENDING THE ZONING MAP OF THE
CITY OF PLAINVIEW, TEXAS TO REZONE PROPERTY
LOCATED AT 1409-1413, 1500, 1502, 1508, 1510,
1512, 1514, 1521, 1600, 1614, 1700, 1704, 1712,
1714, 1801, 1811 AND 1601-1721 (OLD BOOKER T.
WASHINGTON SCHOOL PROPERTY) WALTER GRIFFIN STREET;
100, 101,102, 105, 107, 108 AND 109 CARVER STREET;
102, 106 AND 108 CAMPBELL STREET; 103,105 AND 107
BRAZIER STREET; AND 1607 AND 1715 N. BROADWAY STREET
FROM AN R-2, RESIDENTIAL - 2, ZONING DISTRICT TO A
C-1, COMMERCIAL - 1, NEIGHBORHOOD SERVICE, ZONING
DISTRICT; CUMULATIVENESS CLAUSE; AND EFFECTIVE DATE.
Whereas, Ordinance No. 89-2798, known as the City of Plainview Zoning Ordinance, sets forth in
Section 5 the requirements for amending the zoning map of the City of Plainview, Texas; and
Whereas, the City of Plainview has requested that property located at 1409-1413, 1500, 1502, 1508,
1510, 1512, 1514, 1521, 1600, 1614, 1700, 1704, 1712, 1714, 1801, 1811 and 1601-1721 (old
Booker T. Washington school property) Walter Griffin Street; 100, 101,102, 105, 107, 108 and 109
Carver Street; 102, 106 and 108 Campbell Street; 103, 105 and 107 Brazier Street; and 1607 and
1715 N. Broadway Street be rezoned from an R-2, Residential-2, Zoning District to a C-1,
Commercial-I, Neighborhood Service, Zoning District; and
Whereas, notice of a public hearing to discuss said rezoning was published in the Plainview Daily
Herald before the 15th day prior to the hearing date; and
Whereas, said hearing was held in the Council Chambers of the City Hall, Plainview, Texas, at which
time persons appeared in support of the proposal; and
Whereas, the proposed rezoning, as hereinafter made, has been duly presented to the Planning and
Zoning Commission for its recommendation which was received by the City Council; and
Whereas, it was determined by the City Council that it would be in the best public interest to rezone
the property as described below in the manner hereinafter set forth in the body of this Ordinance;
Now, therefore, be it ordained, by the City Council of the City of Plainview, Texas that:

SECTION i
The request of the City of Plainview to rezone from R-2 to C-1 a parcel of property described as
follows:
Lots 11-21, Block 7, Wye Addition No. 2 (excluding those portions of lots 17-21 which now comprise
the extension of 16th Street); Lots 1-11. Block 8, Wye Addition No. 3;and Lots 1-12, Block 9, Wye
Addition No. 4; and Lots 1~12, Block 14, Wye Addition No. 4;-and a 133.4' x 923.8' tract of land out
of the John Kiser Homestead Survey, Abstract 1154 being bounded on the South by Block 7 of Wye
Addition No. 2, on the North by the AUstin Heights Addition, and on the EaSt by Walter Griffin Street
[1409-1413, 1500, 1502, 1508, 1510, 1512, 1514, 1521, 16001614, 1700, 1704, 1712, 1714, 1801,
1811 and 1601,1721 (oldrBooker T. Washington SchoOl .property) Walter Griffin Street; 100, 101,
102, 105, 107, 108 and 109 Carve~ 106 and 108 Campbell Street; 103, 105 and 107
Brazier Street; and 1607 and 1715 I~
is hereby granted.
SECTION II
Provisions of this ordinance are cumulative and nothing herein shall prevent, alter or diminish
the applicability or enforcement of other ordinances restricting, regulating or governing the subject
matter herein.
SECTION iil
All ordinances or portions of any ordinance of the City of Plainview, Texas in conflict herewith,
are hereby amended to conform with the provisions hereof.
SECTION IV
Should any section, subsection or any portion hereof be deemed invalid for any reason, such
holding shall not render or invalidate any other section, subsection, sentence, provision, clause,
phrase or word severable therefrom and the same shall be deemed severable for this purpose.
SECTION V
This ordinance shall be of full force and effect upon its passage and publication as required
by law.
