HomeMy WebLinkAbout94-3007196 ZONING ORDINANCE - ACCESSORY BUILDINGS ORDINANCE NO. 94-3007 AN ORDINANCE OF THE CITY OF PLAINVIEW, TEXAS, AMENDING THE ZONING ORDINANCE NO. 89-2798; PROVIDING FOR ANAr~NDMENT TO SECTION 34:1 (1), ~?,:~::;_~,-ACCESSORY BUILD~:;%CUMULATIVENESS CLAUSE; CONFLICTS (~LAuS~i~i~RABILITY CLAUSE; AND EFFECTIVE DATE. WHEREAS, Ordinance No. 89-2798, known as the City of Plainview Zoning Ordinance, sets forth the zoning districts and corresponding map for the City of Plainview in accordance with state law; and WHEREAS, from time to time it is advisable to review the Zoning Ordinance and update such; and WHEREAS, it is found to be in the best interests ofthe City of Plainview to amend the following section. NOW, THEREFORE, BE IT ORDAINED, by the City Council of the City of Plainview, Texas that: SECTION I Section 34:1 of the Plainview Zoning Ordinance is hereby amended to read as follows: 34:1. ACCESSORY BUILDINGS Accessory buildings detached from, or attached to the main building by an enclosed or unenclosed structure, may be permitted within the allowable building area of any lot defined by the required front, side and rear building lines under the following conditions: 1. No accessory buildings may be permitted in the required front yard. Accessory buildings may be permitted in the required rear yard and side yard, provided: go That they are detached from the main building or structure and separated therefrom by a distance of not less than ten (10) feet. b. If an accessory building is located less than ten (10) feet from a rear lot 1 of 3 - Zoning Amendment Ord 197 SECTION II line, the height of the building shall be no greater than twelve (12) feet. Said accessory buildings have a side yard setback of not less than three (3) feet. Said accessory buildings shall not be required to have a rear setback if they abut an alleyway. Said accessory buildings shall have a rear setback of not less than three (3) feet if the property abuts property which is not an alleyway. Accessory buildings must be secured and tied down. No accessory building shall be allowed to aerially encroach in an alleyway. Provisions of this ordinance are cumulative and nothing herein shall prevent, alter, or diminish the applicability or enforcement of other ordinances restricting, regulating or governing the subject matter herein. SECTION III All ordinances or portions of any ordinance of the City of Plainview, Texas in conflict herewith, are hereby amended to conform with the provisions hereof. SECTION IV Should any section, subsection, or any portion hereof be deemed invalid for any reason, such holding shall not render or invalidate any other section, sub-section, sentence, provision, clause, phrase, or word severable therefrom and the same shall be deemed severable for this purpose. SECTION V This ordinance shall be of full force and effect upon its passage and publication as required by law. PASSED AND APPROVED this the 23rd day of August, 1994.
