HomeMy WebLinkAbout94-3012206' ZONING ORDINANCE - AREA, SETBACK, HEIGHT, COVERAGE, AND DENSITY ORDINANCE NO. 94-3012 AN ORDINANCE OF THE CITY OF PLAINVIEW, TEXAS, AMENDING THE ZONING '"'0~,.RDINANCE NO. 89-2798; TO SECTION 32:1 (1), AND DENSITY REGULATIONS; CUMULATIVENESS CLAUSE; CONFLICTS CLAUSE; SEVERABILITY CLAUSE; AND EFFECTIVE DATE. WHEREAS, Ordinance No. 89-2798, known as the City of Plainview Zoning Ordinance, sets forth the zoning districts and corresponding map for the City of Plainview in accordance with state law; and WHEREAS, from time to time it is advisable to review the Zoning Ordinance and update. such; and WHEREAS, it is found to be in the best interests of the City of Plainview to amend the following section. NOW, THEREFORE, BE IT ORDAINED, by the City Council of the City of Plainview, Texas that: SECTION I Section 32:1 (1) of the Plainview Zoning Ordinance is hereby amended to add the following to the Notes: Additions to homes may be aligned with the existing side setback up to five (5) feet from the property line provided the current side setback line existed prior to the adoption of Ordinance No. 89-2798. No additions may be built closer than five (5) feet from the property line. SECTION II Provisions of this ordinance are cumulative and nothing herein shall prevent, alter, or diminish the applicability or enforcement of other ordinances restricting, regulating or governing the subject matter herein. 1 of 2 - Zoning Ordinance Ame 207 SECTION III All ordinances or portions of any ordinance of the City of Plainview, Texas in conflict herewith, are hereby amended to conform with the provisions hereof. SECTION IV Should any section, subsection, or any portion hereof be deemed invalid for any reason, such holding shall not render or invalidate any other section, sub-section, sentence, provision, clause, phrase, or word severable therefrom and the same shall be deemed severable for this purpose. SECTION V This ordinance shall be of full force and effect upon its passage and publication as required by law. PASSED AND APPROVED this the 23rd day of August, 1994.
