Building Code Amendment
ORDINANCE NO. 94-3013
AN ORDINANCE OF THE CITY OF PLAINVIEW, TEXAS
AMENDING § 6-17 OF THE PLAINVIEW CODE OF
ORDINANCES ~ TO PROVIDE FOR AN AMENDMENT TO
CHAPTER 12 OF THE UNIFORM BUILDING CODE;
SEVERABILITY CLAUSE; CUMULATIVENESS CLAUSE;
CONFLICTS CLAUSE; AND EFFECTIVE DATE.
WHEREAS, on August 4, 1994, the Building Code and Fire Code Board of Appeals approved
an amendment to § 1204 of the Uniform Building Code; and
WHEREAS, the City Council of the City of PlainView, Texas f'mds that it is in the best interest
of the safety and welfare of the citizens of Plainview to reduce said amendment to ordinance
form;
NOW, THEREFORE, BE IT ORDAINED tS~.~th~ City Council of the City of Plainview, Texas
that:
SECTION I:
Section 6-17 of the Plainview Code of Ordinances is hereby amended to add the following
change to § 1204 of the Uniform Building Code:
Exits and Emergency Escapes
Sec. 1204. Stairs, exits, and smokeproof enclosures shall be specified in Chapter 33.
Basements in dwelling units and every sleeping room below the fourth story Shall have
at least one operable window or door approved for emergency escape or rescue which shall open
directly into a public street, public alley, yard or exit court. The units shall be operable from the
inside to provide a full clear opening without the use of separate tools.
All escape or rescue windows from sleeping rooms in one or two story single-family
residence only shall be classified into windows which have sash that slide in a frame or sash that
hinge or pivot in the frame. All windows which slide in the frame shall have a net clear opening
of three and eight-tenths (3.8) square feet, with minimum clear opening dimensions of twenty
(20) inches either height or width. All windows which pivot in the frame shall have a net clear
opening of four and eight-tenths (4.8) square feet, with a minimum dimension of sixteen inches
(16"). Where windows are provided as a means of escape or rescue they shall have a finished
sill height not more than 44 inches (44") above the finished floor.
Bars, grilles, grates or similar devices may be installed on an emergency escape or rescue
windows or doors, provided:

Such devices are equipped with approved release mechanisms which are openable
from the inside without the use of a key or special knowledge or effort; and
The building is equipped with smoke detectors installed in accordance with
Section 1210.
SECTION II.
If any section, subsection, sentence, clause, phrase, or portion of this ordinance is, for any reason,
held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be
deemed a separate, distinct, and independent provision and such holding shall not affect the
validity of the remaining provisions thereof.
SECTION III.
Provisions of this ordinance are cumulative and nothing herein shall prevent, alter, or diminish
the applicability or enforcement of other ordinances restricting, regulating, or governing the
subject matter herein.
SECTION IV.
All ordinances or portion of any ordinance of the City of Plainview, Texas, in conflict herewith,
are hereby amended to conform with the provisions hereof.
SECTION V.
This ordinance shall be of full force and effect upon its passage.
