HomeMy WebLinkAbout02-3319 ordZONING ORDINANCE - Zone Case No. 704 (317 W. 6th St.) Specific Use Permit ORDINANCE NO, 02-3319 AN ORDINANCE AMENDING THE ZONING MAP OF THE CITY OF PLAINVIEW BY ISSUANCE OF A SPECIFIC USE PERMIT TO OPERATE AN ARCADE IN A GENERAL COMMERCIAL (C- 3) ZONING DISTRICT SAID PARCEL OF LAND BEING LOTS 3-4, E 30' OF LOT 5, S 70' OF THE W 20' OF LOT 5, THE S 70' OF LOT 6, BLOCK 46, ORIGINAL TOWN, THE SAME BEING 317 W. 6TM STREET; CUMULATIVENESS CLAUSE; CONFLICTS CLAUSE; SEVERABILITY CLAUSE; AND EFFECTIVE DATE. WHEREAS, Ordinance No. 89-2798, known as the City of Plainview Zoning Ordinance, sets forth in Section 33 the requirements for obtaining a specific use permit; and WHEREAS, Dods Cook has requested a Specific Use Permit to operate an arcade in a General Commercial (C-3) Zoning District, same being 317 W. 6~ Street, Plainview, Hale County, Texas; and WHEREAS, the proposed issuance of a specific use permit, as herein after made, has been duly presented to the Planning and Zoning Commission for its recommendation, which was received by the City Council; and WHEREAS, the Planning and Zoning Board has recommended to the City Council to waive the three hundred (300) foot distance requirement from a residential district because it will not be detrimental or injurious to the public health, safety or general welfare, or otherwise offensive to the neighborhood; and WHEREAS, a headng was held in the Council Chambers of the City Hall, Plainview, Texas, at which time persons appeared in support of or against said proposal; and WHEREAS, the City Council has determined that waiver of the three hundred (300) foOt distance requirement from a residential district will not be detrimental or injurious to the public health, safety or general welfare, or otherwise offensive to the neighborhood; and WHEREAS, it was determined by the City Council that issuance of the Specific Use Permit would not be detrimental or injurious to the public health, safety or general welfare, or otherwise offensive to the neighborhood, said Specific Use Permit shall issue in the manner hereinafter set forth in the body of this Ordinance; NOW, THEREFORE, The City of Plainview Hereby Ordains that: OrdinanCe No, 02-3319 Specific Use Permit Zone Case No. 704 Page 1 of 3 154 The request of Doris Cook for a Specific Use Permit to operate an arcade in a General Commercial (C-3) Zoning District, said parcel:being a Lots 3-4, E 30' of Lot 5 and the S 70' of W 20' of Lot 5, and the S 70' of Lot 6, Block 46, Odginal Town Subdivision, the same being 317 W. 6th Street, Plainview, Hale County, Texas is:approved with ~the following stipulations; 1. Lighting be proVided and maintained in parking area for safety to the property owners. 2. Debris and trash on property be kept up with daily. 3. The east door be an exit only with a panic bar. Provisions of this ordinance are cumulative and nothing herein shall prevent, alter, or diminish the applicability or enforcement of other ordinances restricting, regulating or governing the subject matter herein. fi~=C. TI~N III All ordinances or portions of any ordinance of the City of Plainview, Texas in conflict herewith, are hereby amended to conform with the p rovisions hereof. fiI=~.TIE)N IV Should any section, subsection, or any portion hereof be deemed invalid for any reason, such holding shall not render or invalidate any other section, sub-section, sentence, provision, clause, phrase, or word severable there from and the same shall be deemed severable for this purpose.
