CANCELLING ELECTION (Districts 2 and 4)
ORDINANCE NO. 02-3330
AN ORDINANCE CANCELLING THE MAY 4, 2002, REGULAR
ELECTION IN DISTRICTS 2 AND 4 AND DECLARING EACH
UNOPPOSED CANDIDATE ELECTED TO OFFICE;
CUMULATIVENESS CLAUSE; CONFLICTS CLAUSE;
S EVERABILITY
WHEREAS, in accordance with law a general election has been ordered
for May 4, 2002, for the purpose of electing Councilmembers in Districts 1, 2, 3
and 4 to serve on the City Council in the City of Plainview; and
WHEREAS, no proposition is to appear on the ballot in that election; and
WHEREAS, the city secretary has certified in writing that each candidate
on the ballot for Districts 2 and 4 is unopposed for election to office; and
WHEREAS, the filing deadlines for placement on the ballot and
declaration of write-in candidacy have passed; and
WHEREAS, in these circumstances Section 2.053(a) of the Election Code
authorizes a governing body to declare each unopposed candidate elected to
office and ca ncel the election.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF PLAINVIEW, TEXAS THAT:
Section 1
The following candidates, who are unopposed in the May 4, 2002, general
election, are hereby declared elected to the specified offices and shall be issued
a certificate of election:
Mary Jane Shanes, City Councilmember District No. 2
John Bertsch, City Councilmember District No. 4
Section 2
The City Secretary is directed to post a copy of this ordi,nance at each designated
polling place on May 4, 2002.

Section 3
Provisions of this ordinance are cumulative and nothing herein shall prevent,
alter, or diminish the applicability or enforcement of other ordinances restricting,
regulating or governing the subject matter herein.
Section 4
All ordinances or portions of any ordinance of the City of Plainview, Texas in
conflict herewith, are hereby amended to conform with the provisions hereof.
Section 5
Should any section, subsection, or any portion hereof be deemed invalid for any
reason, such holding shall not render or invalidate any other section, subsection,
sentence, provision, clause, phrase, or word severable therefrom and the same
shall be deemed severable for this purpose.
Section 6
This ordinance shall be of full force and effect upon its passage and publication
as required by law.
PASSED AND APPROVED on first reading this 9th day of April, 2002.

As the authority responsible for having the official ballot prepared, I
hereby certify that the following candidates are unopposed for
election to office for the election scheduled to be held on May 4,
2002.
