The Plainview City Council met on March 12, 2002, at 7:00 p.m. in the Council
Chambers of Plainview City Hall, 901 Broadway. The Council met in pre-session at
6:30 p.m. The agenda for this meeting was posted at City Hall at 10:00 a.m. on March
6, 2002. Mayor Lloyd C. Woods presided. Councilmembers present were: Sam
Parker-District 1, Mary Jane Shanes-District 2, Rey Rosas-District 3, Mike Hutcherson-
District 4, Ross Owen-District 5, Buddy McGehee-District 6 and Irene Favila-District 7.
Staff presentwere: James P. Jeffers-City Manager, John Berry-Director of Public
Works, John Castro-Director of Community Development, Gary Glass-Fire Chief,
William Mull-Chief of Police, Dale Simpson-Director of Civil Service, Wally Hatch-City
Attorney, Elizabeth Regner-Assistant City Manager and Belinda Hinojosa-City
Secretary.

Guests present were: Terry Teeter, Dennis Harkins, Kathy Burton, Jennifer Burton,
Justin Burton, Verdell Burton and Janice Burton
The Girl Scouts led in the Pledge of Allegiance.
Councilmember Hutcherson moved the Consent Calendar be approved as presented.
The motion, duly seconded by Councilmember Shanes, carried by unanimous vote.
Items approved on the Consent Calendar included: approval of the minutes of February
26, 2002 and March 7, 2002; receipt of departmental reports; and approval of
expenditures. The Council approved the appointment of David Barbian to the vacant
seat on the Coordinating Board of Economic Development in District 1; the appointment
of David Julian as alternate to the Building Trades and Fire Code Board of Appeals with
a term ending January 1, 2003; the reappointment of David Julian to the Planning &
Zoning Commission with term ending January 1, 2004; and the reappointment of John
Bickel to the Board of Adjustment with a term ending December 31, 2003.
Mayor Woods presented Ordinance No. 02-3319, an Ordinance Amending the Zoning
Map of the City of Plainview By Issuance of a Specific Use Permit To Operate An Arcade
in a General Commercial (C-3) Zoning District Said Parcel of Land Being Lots 3-4, E 30'
Of Lot 5, S 70' of the W 20' Of Lot 5, The S 70' Of Lot 6, Block 46, Original Town, the
Same Being 317 W. 6th Street; Cumulativeness Clause; Conflicts Clause; Severability
Clause; And Effective Date for second reading. There was no public comment. Mayor
Woods moved that Ordinance No. 02-3319 be approved upon second reading. The
motion duly seconded by Councilmember Owen, carried by unanimous vote.
Mr. John Castro, Director of Community Services presented Ordinance No. 02-3321, an
Ordinance Amending the Zoning Map of the City Of Plainview By Issuance of a Specific
Use Permit to Operate an Arcade in a General Commercial (C-3) Zoning District Said
Parcel of Land Being Unit 1, Lot 2, Mesa Verde Addition, the Same Being 1001 N I 27
Suite 70; Cumulativeness Clause; Conflicts Clause; Severability Clause; And Effective
Date for first reading. He stated it was discovered that Cinema 6 was not in compliance
with city ordinance in that it had more than the five allowed arcade machines. He stated
that the Theater is not close to any school or church and does not pose any parking
problems. Two responses were received and all were in favor of granting the specific use
permit. Terry Teeter of 1001 N. 1-27 stated that the Theater would have computerized
games. Councilmember Shanes moved that Ordinance No. 02-3321 be approved upon

first reading. The motion duly seconded by Councilmember Rosas, carried by unanimous
vote.
George Meriwether of 207 S. Garland presented the 2000-2001 Audit. He stated the City
was in good financial condition and that the records were in good condition.
Councilmember Rosas moved to accept the report. The motion duly seconded by
Councilmember Hutcherson, carded by unanimous vote.
Chief of Police Will Mull presented the Police Department Annual Report. He stated the
figures all seemed to stay relatively the same.
Mayor Woods that the meeting be adjourned.
Councilmember Owen carded by unanimous vote.
