HomeMy WebLinkAbout95-3031250 Speed Zone ORDINANCE NO. 95-3031 AN ORDINANCE OF THE CITY OF PLAINVIEW, TEXAS, AMENDING SECTION 23-168 OF THE CODE OF ORDINANCES TO ESTABLISH A MAXIMUM RATE OF SPEED FOR VEHICLES TRAVELING EASTBOUND AND WESTBOUND ON FM 3466 (S.W. 3RD STREET); PROVIDING FOR A PENALTY; CUMULATIVENESS CLAUSE; CONFLICTS CLAUSE; SEVERABILITY CLAUSE; AND EFFECTIVE DATE. WHEREAS, the City Council of the City of Plainview, upon the basis of engineering and traffic investigation, finds it necessary to amend maximum speed limits on FM 3466 (S.W. 3rd Street) for traffic traveling eastbound and westbound within the corporate limits of the City of Plainview, Texas; and WHEREAS, the City Council finds it in the best interest of the public safety of the citizens of the City of Plainview to amend § 23-168 to reflect these changes; and NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Plainview, Texas that: Section I § 23-168 be amended to add the following: Street S.W. 3rd Street (FM 3466) Eastbound & Westbound Extent ~r '~ MPH Beginning at the west right-of-way line of the grade separation for. W. 3rd Street, for a distance of 0.972 mile, a point 900 feet east of the center line of Ennis Street ................ Thence for a distance of 0.833 mile, this point being the centerline of Joliet Street extending to the north ............. Thence for a distance of 0.487 mile, this point being the west right of way line of Business IH27 (Columbia Street} ......... 50 55 45 Page 1 of 2 251 Section II Any person who shall violate or fail to comply with the provision of this. ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof, shall be punished by a fine of not less than ~ 1.00 and not more than $200.00. Section III Provisions of this ordinance are cumulative .and nothing herein shall prevent, alter, or diminish the applicability or enforcement of other ordinances restricting, regulating or governing the subject matter b~rein. Section IV ' ~ ~ All ordinances or portions of any ordinance of the City of Plainview, Texas in conflict herewith, are hereby amended to conform with the provisions hereof. Section VI Should any section, subsection, or any portion hereof be deemed invalid for any reason, such holding shall not render or invalidate any other section, sub-section, sentence, provision, clause, phrase, or word severable therefrom and the same shall be deemed severable for this purpose. Section VII This ordinance shall be of full force and effect upon its passage and publication as required by law. PASSED AND APPROVED this 24th day of January, 1995. Lloyd C.
