HomeMy WebLinkAbout95-3033255 ZONING ORDINANCE - AMENDMENT ORDINANCE NO. 95-3033 AN ORDINANCE AMENDING THE ZONING ORDINANCE NO. 89-2798; PROVIDING FOR AN AMENDMENT TO SECTION 32:1 (1), AREA, SETBACK, HEIGHT, COVERAGE, AND DENSITY REGULATIONS; CUMULATIVENESS CLAUSE; CONFLICTS CLAUSE; SEVERABILITY CLAUSE; AND EFFECTIVE DATE. WHEREAS, Ordinance No. 89-2798, known as the City of Plainview Zoning Ordinance, sets forth the zoning districts and corresponding map for the City of Plainview in accordance with state law; and WHEREAS, from time to time it is advisable to review the Zoning Ordinance and update such; and WHEREAS, it is found to be in the best interests of the City of Plainview to amend the following section. Section 32:1 (1) of the Plainview Zoning Ordinance is hereby amended by following to p. adding the the Notes: Any duplexes in a 2F, Duplex and Patio Home Residential District, which adjoin an R-l, Single Family Residential District, will have an eight (8) foot side setback on the side adjoining the R-1 zone. If the existing structure in the adjacent R-1 zone has a non-conforming side setback, the duplex will 1 of 2 - Zoning Ordinance Amendment 256' require a minimum five (5) foot-side setback. SECTION II Provisions of this ordinance are cumulative and nothing herein shall prevent, alter, or diminish the applicability, or enforcement of other ordinances restricting, regulating or governing the subject matter herein. SECTION III All ordinances or portions of any ordinance of the City of Plainview, Texas in conflict herewith, are hereby amended to conform with the provisions hereof. SECTION IV Should any section, subsection, or any portion hereof be deemed invalid for any reason, such holding shall not render or invalidate any other section, sub-section, sentence, provision, clause, phrase, or word severable therefrom and the same shall be deemed severable for this purpose.
