ORDINANCE NO. 95-3034
AN ORDINANCE OF THE CITY OF PLAINVIEW, TEXAS
CREATING SECTION 5-137 OF THE PLAINVIEW CODE OF
ORDINANCES TO ADOPT CHAPTER 826 OF THE TEXAS
HEALTH AND SAFETY CODE; SEVERABILITY CLAUSE;
CUMULATIVENESS CLAUSE; AND EFFECTIVE DATE.
WHEREAS, the City Council of the CJ~ty of Plainview, Texas desires to enact a more

WHEREAS, the City Council recognizes that Chapter 826 of the Texas Health and Safety
Code provides for such comprehensive regulation of rabies; and
WHEREAS, for the advancement of the health and welfare of the citizens of Plainview the
City Council desires to supplement the current ordinance with the adoption of said Chapter
826;
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Plainview,
Texas that:
SECTION I:
Section 5-137 of the Plainview Code of Ordinances is hereby created to read as follows:
Sec. 5-137. Adoption of Chapter 826, Texas Health and Safety Code
All rules and regulations found in Chapter 826, Texas Health and Safety Code, as
amended, are hereby adopted and incorporated herein in its entirety, except when less
stringent than any rule or regulation promulgated in Chapter 5 of the Plainview Code of
Ordinances. Should any provision of the Chapter 5 of the Plainview Code of Ordinances
apply more strictly, said provisions shall prevail.
SECTION II
Should any section, subsection, or any pOrtion hereof be deemed invalid for any reason, such
holding shall not render or invalidate any other section, sub-section, sentence, provision,
clause, phrase, or word severable therefrom and the same shall be deemed severable for this
purpose.
SECTION III
Provisions of this ordinance are cumulative and nothing herein shall prevent, alter, or

diminish the applicability or enforcement of other ordinances restricting, regulating or
governing the subject matter herein.
SECTION IV
This ordinance shall be of full force and effect upon its passage and publication as required
by law.
