PARKS ADVISORY BOARD
ORDINANCE NO. 95-3035
AN ORDINANCE CREATING ARTICLE VI, PARKS
ADVISORY BOARD, OF CHAPTER 18, PARKS AND
RECREATION; PROVIDING FOR THEIR APPOINTMENT,
TERMS OF OFFICE AND DUTIES AND
RESPONSIBILITIES; SEVERABILITY CLAUSE;
CUMULATIVENESS CLAUSE; CONFLICTS CLAUSE; AND
EFFECTIVE DATE.
WHEREAS, there exists a need for a Parks-Advisory Board to work in cooperation
with the Plainview City Council and the Parks Department.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF PLAINVIEW THAT:
SECTION I.:
The following sections are hereby created in Chapter 18, Parks and Recreation, of the
Plainview Code of Ordinances:

ARTICLE VI.
PARKS ADVISORY BOARD
Sec. 18-101. Board created; membership.
The Parks Advisory Board shall consist of eight (8) residents of the City of Plainview
appointed by the Mayor and City Council. Each councilmember shall nominate one
individual The Mayor shall nominate one individual to serve as Chair of the Parks Advisory
Board. The nominees must be confirmed by the City Council.
The eight (8) appointed members shall be voting members of the Parks Advisory
Board. The Parks Superintendent shall serve as secretary.
Sec. 18-102. Duties of Committee.
The duties of the Parks Advisory Board shall include the following:
a. Recommendations in regard to open space planning, parks, and recreation
planning and/or the purchase, disposal, or trade of such lands;

b. Recommendations involving the coordination of the Comprehensive or Master
Plans, or future plans, within the City of Plainview Parks Department;
c. Recommendations on any other matter pertaining to open space, parks,
recreation, or land planning problems;
d. Recommendations on priorities for spending funds. The Board shall not lobby
the City Council for appropriations, but will merely make recommendations on how
appropriated funds should be' expended.
e. Progress reports of the Parks Advisory Board shall be submitted to the Plainview
City Council quarterly.
Sec. 18-104. Terms; vacating office.
Members of the Parks Advisory Board shall hold their office for a term of four (4)
years, except that two (4) of the eight (8) members appointed during the year 1995 shall
hold office for two (2) years and the other four (4) members shall hold office for terms of
four (4) years, and the term of each to be determined by lot and thereafter their successors
shall hold office for four (4) years and until their successors are appointed. There shall be
no limit on the number of terms a member may serve, provided the member is reappointed
by the City Council.
Should any member of the Parks Advisory Board move out of the city limits of the
City of Plainview and cease to be a legal resident of the City of Plainview, his/her office
shall automatically become vacant and shall be filled in the manner provided above.
Sec. 18-105. Mandatory_ attendance.
Each member of the Board shall attend no less than 75 % of the regular meetings
called by the officers of the Board. The secretary of the Board shall make a quarterly
report to the Mayor and City Council showing the attendance of each member of the Board.
Any representative failing to attend 75% of the regular meetings legally called during any
calendar year without an excused absence, as determined by a majority vote of the Board
members, shall be automatically disqualified for service on the Board and shall be replaced
by the City Council.
SECTION II.
Should any section, subsection, or any portion hereof be deemed invalid for any reason, such
holding shall not render or invalidate any other section, sub-section, sentence, provision,
clause, phrase, or word severable therefrom and the same shall be deemed severable for this
purpose.
SECTION III.
Provisions of this ordinance are cumulative and nothing herein shall prevent, alter, or
diminish the applicability or enforcement of other ordinances restricting, regulating or
governing the subject matter herein.
SECTION IV.
All ordinances or portions of any ordinance of the City of Plainview, Texas in conflict

herewith, are hereby amended to conform with the provisions hereo£
SECTION V
This ordinance shall be of full force and effect upon its passage.
