RESOLUTION R10 -223
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLAINVIEW,
TEXAS, APPROVING THE REQUEST OF PLAINVIEW RADIO IN
CONJUNCTION WITH HALE COUNTY DAIRY FAMILIES TO HOST THE
2010 ANNUAL RED, WHITE & MOO PARADE; AUTHORIZING THE
FILING OF THE AGREEMENT FOR THE TEMPORARY CLOSURE OF
STATE RIGHT -OF -WAY WITH THE TEXAS DEPARTMENT OF
TRANSPORTATION FOR THIS ANNUAL PARADE; DECLARING THAT
THE EVENT SERVES A PUBLIC PURPOSE; AND AGREEING TO
COMPLY WITH REGULATIONS.
WHEREAS, the Texas Department of Transportation owns and operates U. S.
Highway 70 in the corporate limits of the City of Plainview; and
WHEREAS, the U. S. Highway 70 crosses Broadway Street within the corporate
limits of the City of Plainview; and
WHEREAS, the intersection of U.S. Highway 70 and Broadway Street is the
critical vein for parade use;
WHEREAS, the City of Plainview has received a request from Plainview Radio in
conjunction with the Hale County Dairy Families to host the 5th annual Red, White &
Moo Parade on July 3, 2010; and
WHEREAS, the City Council of the City of Plainview finds that such parade
serves a public purpose in that the parade celebrates this nation's birthday as well as
recognizes the significance of the dairy industry in this area; and
WHEREAS, the City Council of the City of Plainview, Texas finds it in the best
interest for the citizens of Plainview that the annual Red, White & Moo Parade be held
this year on July 3, 2010 and use the traditional parade route on Broadway Street,
which originates at Santa Fe Depot (Broadway at 12 Street), and goes south, crossing
U.S. Highway 70, and concludes at Broadway Park; and
WHEREAS, the Texas Department of Transportation requires the Local
Government to submit a completed Agreement for the Temporary Closure of State
Right of Way for use of U.S. Highway 70 in such public events as a parade; and
WHEREAS, the City Council designates Mayor John C. Anderson as the City's
authorized official. The authorized official is given the power to apply for or terminate
such Agreement on behalf of the City.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PLAINVIEW THAT:

The request from Plainview Radio in conjunction with the Hale County Dairy
Families to host the 5 annual Red, White & Moo Parade for July 3, 2010 is hereby
approved.
The public purpose of the parade is to celebrate this nation's birthday as well as
recognize the significance of the dairy industry in this area.
Submission of the completed AGREEMENT FOR THE TEMPORARY CLOSURE
OF STATE RIGHT -OF -WAY with the Texas Department of Transportation is hereby
approved.
The Mayor is hereby authorized and directed to execute, respectively, on behalf
of the City of Plainview, all necessary documents, including the AGREEMENT FOR
THE TEMPORARY CLOSURE OF STATE RIGHT -OF -WAY, to complete the parade
preparation process.
