CHAPTER 20-PLUMBING ORDINANCE NO. 95-3045 AN ORDINANCE OF THE CITY OF PLAINVIEW, HALE COUNTY, TEXAS, AMENDING THE CODE OF ORDINANCES, CHAPTER 20, SECTIONS 20 AND 22.5; PROVIDING USES FOR ~T & P VALVE DRAIN, SCHEDULE 40 (CELLULAR CORE), UNVENTED HEATERS, AND SINGLE WALL- METAL VENT CONNECTORS; CUMULATIVENESS CLAUSE; CONFLICTS CLAUSE; SEVERABILITY CLAUSE; AND EFFECTIVE DATE. WHEREAS, City of Plainview Code of Ordinances, Chapter 20, outlines permissible materials for various uses subject to restrictions; and WHEREAS, from time to time it is advisable to review the Code of Ordinances and update such; and WHEREAS, it is found to be in the best interests of the City of Plainview to amend the following section. NOW, THEREFORE, BE IT ORDAINED, by the City Council of the City of Plainview, Texas that: SECTION I Ordinance No. 85-2587, of the Plainview of Ordinances is hereby amended make the Section 20-142, Use of Materi; Materials and Use Table, to add the following; Schedule 40 (Cellular Core) DWV, (drain, waste and vent), in all approved locations for the list in Section, and; Section 20-235, Water Heaters, to add the following; T & P Valve Drain, using CPVC or other hot water material lines to run to condensate drain trap, or other approved traps, and; Section 20-265, Listed Appliances and Accessories, to add the following; (d) Unvented gas-burning room heaters equipped with an Integral Oxygen 1 of 3 3.0 3 Depletion Sensing system (ODS) may be installed in Group R-3 occupancies if the unit is Certified by an approved scientific testing laboratory and it is installed in accordance with the National Fuel Gas Code as, copyrighted in 1992, by the American Gas Association, 1515 Wilson Boulevard, Arlington, VA 22209. (e) Existing gas-burning unvented room heater(s) installed in R-3 occupancies which do not comply with code requirements shall be removed or replaced with vented or other approved heaters when alterations or remodeling of the structure occur which would require a building permit, or when a city pressure test is required on the gas line system. Additionally all gas outlets for room heaters in bathrooms and bedrooms shall be capped. Homeowners that are living in their homestead are exempted from the requirement of removing the non-approved heaters when a pressure test of the gas line is done. However, the requirements to replace unvented heaters shall be~enforced when a building permit is required. and Vents, (b), to add the following; O) Connectors used for fuel burning appliances have draft hoods may be constructed of non-combustible materials having resistance to corrosion not less than that of galvanized sheet steel and be of a thickness not less than 28 gauge for 5 inch or less diameter connectors and 26 gauge for 5 to 9 inch diameter connectors or they may be of type B or type L vent material. (2) Single wall metal vent connectors shall be securely supported and joints fastened with sheet metal screws, rivets, or other approved means. Shall be installed with clearance to combustibles of not less than six (6) inches. (3) Single wall metal pipe used as a connector shall not originate in an un- occupied attic or concealed space and shall not pass through any attic, inside wall, floor or concealed space and shall be located in the same room or space as the fuel burning appliance. Provisions of this ordinance are cumulative and nothing herein shall prevent, alter, or diminish the applicability or enforcement of other ordinances restricting, regulating or governing the subject matter herein. SECTION II 2 of 3 304 All ordinances or portions of any ordinance of the City of Plainview, Texas in conflict herewith, are hereby amended to conform with the provisions hereof. SECTION III Should any section, subsection, or any portion hereof be deemed invalid for any reason, such holding shall not render or invalidate any other section, sub-section, sentence, provision, clause, phrase, or word severable therefrom and the same shall be deemed severable for this purpose. SECTION IV This ordinance shall be of full force and effect upon its passage and publication as required by law. PASSED AND APPROVED this the 23th day of May, 1995.
