ORDINANCE NO. 95-3040
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF PLAINVIEW, TEXAS, CREATING ARTICLE XVIII OF
THE CODE OF ORDINANCES AUTHORIZING THE MAYOR
AND CITY COUNCIL TO OBTAIN MAJOR MEDICAL
HEALTH INSURANCE PURSUANT TO THE PROVISIONS
OF CHAPTER 172 OF THE TEXAS LOCAL GOVERNMENT
CODE; PROVIDING FOR THE CLASSIFICATION OF
ELECTED OFFICIALS; SEVERABILITY CLAUSE;
CUMULATIVENESS CLAUSE; CONFLICTS CLAUSE; AND
EFFECTIVE DATE.
WHEREAS, Chapter 172 of the Texas Local Government Code, cited as the Texas
Political Subdivision Employees Uniform Group Benefits Act, provides for the recognition
of service to political subdivisions by elected officials by extending to them the same
accident and health benefits coverages as are provided for political subdivision employees;
and
WHEREAS, Section 172.004 of the Texas Local Government Code further provides
that a political subdivision, directly or through a risk pool, may provide health and accident
coverage for political subdivision officials, employees, and retirees or any class of officials,
employees or retirees; and
WHEREAS, the City Council of the City of Plainview, Texas, desires to allow
continuing coverage to former mayors and councilmembers once they have served at least
one (1) complete 4-year term; and
WHEREAS, there is a public purpose served by continuing said health insurance
coverage to former mayors and councilmembers in that former mayors and councilmembers
shall continue to serve the public interest as advisors to the city in their areas of expertise;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF PLAINVIEW TEXAS THAT:
The following sections of Chapter 2, Administration, are created as follows:

Sec. 2-291. Classification, eligibility.
For the purposes of this Article, all current and future mayors and city
councilmembers and their dependents shall be eligible for participation in the City of
Plainview's group medical insurance plan as authorized by Chapter 172 of the Texas Local
Government Code subject to the following stipulations:
(a) In order to continue coverage after vacating elected office, the councilmember
or mayor shall have served at least one (1) full 4-year term of office prior to vacating said
office; and
(b) In no event shall a councilmember or mayor be allowed to participate in the City
of Plainview's group medical insurance plan after vacating office if said councilmember or
mayor did not participate in the group medical insurance plan while in :office.
(c) In no event shall any councilmember or mayor's dependents be eligible for
coverage under the City of Plainview's group medical insurance plan unless it is obtained
by and through an eligible and participating councilmember or mayor.
Sec. 2-292. Payment of premiums.
Each councilmember or mayor choosing to participate in the group medical insurance
plan shall be responsible for the cost of any coverage obtained hereunder.
Sec. 2-293. Effective date.
This article shall be effective as of April 25, 1995.
SECTION II.
If any section, subsection, sentence, clause, phrase, or portion of this ordinance is, for
any reason, held invalid or unconstitutional by any court of competent jurisdiction, such portion
shall be deemed a separate, distinct, and independent provision and such holding shall not affect
the validity of the remaining provisions thereof.
SECTION III.
Provisions of this ordinance are cumulative and nothing herein shall prevent, alter, or
diminish the applicability or enforcement of other ordinances restricting, regulating, or
governing the subject matter herein.
SECTION IV.
All ordinances or portion of any ordinance of the City of Plainview, Texas, in conflict
herewith, are hereby amended to conform with the provisions hereof.
SECTION V.
This ordinance shall be of full force and effect upon its passage.
