ORDINANCE NO. 92-2893
AN ORDINANCE FIXING THE MAXIMUM RATE OF
SPEED FOR MOTOR VEHICLES; ALLOWING FOR SPEED
ZONES; PROVIDING FOR PENALTY; AND DECLARING
AN EMERGENCY.
WHEREAS, the City Council of the City of Plainview, upon the basis of engineering and traffic
investigation, finds it necessary to establish maximum speed limits and create in certain areas all
within the corporate limits of the City of Plainview, Texas;
WHEREAS, the City Council of the City of Plainview, Texas, also finds it necessary to
immediate preservation of the public health and safety to provide for immediate enactment of
such measures, constituting an emergency;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
PLAINVIEW:
Section I.
Speed restrictions. It shall hereafter be unlawful for any person to drive or operate a
motor vehicle upon any street, roadway, or highway in the city limits of the City of
Plainview, Texas, at a speed greater than is reasonable and prudent under the conditions
then existing, having regard to the actual and potential hazards when approaching and
crossing an intersection or railway grade crossing, when approaching and going around
a curve, when approaching a hill crest, when traveling upon any narrow ~or winding
roadway, or when special hazard exists with respect to pedestrians or other traffic or by
reason of weather or highway conditions; and in every event, speed shall be so controlled
as may be necessary to avoid colliding with any person, vehicle or other conveyance or
on entering the highway in compliance with legal requirements and the duty of all persons
to use due care.
Where no special hazard exists that requires lower speed for compliance with Subsection
(A) of this Section, the speed of any vehicle not in excess of the limits specified in this
Subsection or established as hereinafter authorized shall be lawful, but any speed in
excess of the limits specified in this Subsection or established as hereinafter authorized
shall be prima facie evidence that the speed is not reasonable or prudent and that it is
lawful.
The speed zones established by the Ordinance shall include all of FM 3466 within the
corporate city limits of the City of Plainview, Hale County, Texas; the maximum speed
shall be as follows:

Beginning at the west right of way of 1-27 (Southwest 3rd Street)
and extending east for a distance of 0.927 miles, the maximum
legal speed for both eastbound and westbound traffic shall be 50
MPH; then 55 MPH for a distance of 0.833 miles; thence 50 MPH
for a distance of 0.0502 miles; then 45 MPH for a distance of
0.487 miles to the point of intersection with the west right of way
line of Business 1-27.
and all Ordinance and parts of Ordinances in conflict herewith are hereby repealed.
Section 2.
Any person violating any of the provisions of this Ordinance shall, upon conviction thereof, be
find in any sum not less than Ten Dollars ($10.00), nor more than Two Hundred Dollars
($200.00).
Section 3.
That the hazards and dangers to public health and safety create a necessity requiring all rules
providing that no Ordinance shall be finally passed on the day of its introduction be suspended;
and this Ordinance is declared to be an emergency measure, to take effect from and after the date
of its first publication.

AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF PLAINVIEW, TEXAS PROVIDING FOR
MUNICIPAL REGULATION OF MEETINGS ON PUBLIC
PROPERTY; SEVERABILITY CLAUSE; CONFLICTS
CLAUSE; AND EFFECTIVE DATE.
WHF. R~S, the City of Plainview recognizes a measure of regulation with
regard to moetings on public property.

NOI~ THEREFORE, be it ordained by the City Council/of the City of
Plainview, Texas that : /

Section I. Meetings on public property. //
/
It shail be unlawful to hold any outdoor meetint~ FOR THE PURPOSE OF
EXPRESSIVE ACTIVITY on public property or c9~duct a processional parade,
unless a permit for such event bas been issued/By the Chief of Police.
(1) Application for USE OF A P~K FOR A RALLY, MEETING
OTHER EXPRESSIVE ACTIVITY sl~l be made to the parks and
recreation department at least five rS) days prior to the events, with a
copy sent to the police depar/t~ent and shall contain the following
information: /
/
(A) A description of t~ event;
/
(B) The day of the/~vent;
(C) The hours th/event will start and terminate;
(D) Location of~e event;
(E) A reason/a~le and good-faith approximation
of the numb~ of persons expected to
attend the/~¥ent;
(F) Th.e/names and addresses of the persons
sponsomng the event.
(G) /Any additional informtion which the Chief of Police shall find
reasonably necessary to make a fair determiniation as to whether a
p~rmit should be is~d.-, i ~
of Police within ten (10) days prior to the event and sinai! set forth the
following information:
(A) The nmme, address, and telephone number of the person
seeking to conduct such parade;

(B) If the parade is proposed to be conducted for, on behalf of ,
or by an organization, the name, address, and telephone number
of the organization, and of the authorized and responsible heads of
such organization;
(C) The name, address, and telephone number of the person who
will be the parade chairman and who will be responsible for the
parade conduct;
(D) The date when the parade is to be conducted; /
(E) The route to be traveled, the starting point, and~/the
termination point;
(F) The approximate number of persons who,~/and animals and
vehicles which, will constitute such par~ade, the type of
arimsds and the description of said vehicles;
(G) The hours when such parade will st~agt and terminate;
(H) A statement as to whether the Darade will occupy all or oniy
a portion of the width of the street, s/ proposed to be traversed;

(I) The location by streets of ~y assembly areas for such
parade;

(J) The time at which un~t~ of the parade veill begin to assemble
at any such assembly are/~ or areas;
(K) The interval of ~s~6ace to be maintained between units of such
parade;

(L) If the parad~e/is designed to be held by and on behalf of or
for any person 9(her than the applicant, the applicant for such
permit shall file/with Chief of Police a communication in writing
from the persflin proposing to hold the parade, authorizing the
applicant to/apply for the permit on his behalf; and
(M) Any~dditionai information which the Chief of Police sba11 find
reasonably necessary to make a fair determination as to whether a
permit ghould be issued.

(3) If the/~roposed rally, meeting, or parade does not comply with the
rules and/gegq,lations for the City of Plainview or the rules and
regulations for parades, the Chief of Police may present alternative
locations, times, routes, or other conditions that will comply. The
applicant can either accept the Police Chief's changes or submit a new
application within forty-eight (48) hours of the event that does comply
with the issues raised by the Police Chief.

(4) Upon compliance with this section, a permit shall be issued by the
Chief of Police.
Section II. Seve~-ability.
If any provision of this ordinance or the application//~ereof to any
person or circun~stances is held invalid, the remainder or. he ordinance and
the appliCation of provisions to other persons and circ~i~tances shall not be
affected hereby. /
Section III. Conflicts.
If any of the provisions of this ordina~/e or the application thereof to
any person or circumstance is in conflict wi)~l~ another provision or ordinance,
the provisions, set forth in this ordinance/s~nall prevail.

Section IV. Effective Date. /
