ORDINANCE NO. 92-2894
AN ORDINANCE FIXING THE MAXIMUM RATE OF SPEED FOR
MOTOR VEHICLES; ALLOWING. FOR SPEED ZONES; PROVIDING
FOR PENALTY; AND DECLARING AN EMERGENCY.
WHEREAS. the City Council of the City of Plalnview. upon the basis of
engineering and traffic investigation, finds it necessary to establish me. mum
speed limits and create in certain areas all within the corporate limits of the
City of Plainview. Texas;
Whereas, the City Council of the City of Plainview, Texas, also finds it
necessary to immediate preservation of the public health and safety to provide
for immediate enactment of such measures, constituting an emergency;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF PLAINVIEW:
Section I. Subsection (A). Speed restrictions.
It shall hereafter be unlawful for any person to drive or operate a motor
vehicle upon any street, roadway, or highway in the city limits of the City of
Plainview, Texas, at a speed greater than is reasonable and prudent under
the conditions then existing, having regard to the actual and potential
hazards when approaching and crossing an intersection or railway grade
crossing, when approaching and going around a curve, when approaching a
bill crest, when traveling upon any narrow or winding roadway, or when
special hazard exists with respect with respect to pedestrians or other traffic
or by reasons or weather or highway conditions; and in every event, speed
shall be so controlled as ,nay be necessary to avoid colliding with any person,
vehicle or other conveyance on or entering the highway in compliance with
legal requirements and the city of all persons to use due care.
Subsection (B).
Where no special hazard exists that requires lower speed for compliance with
Subsection (A) of this Section, the speed of any vehicle not in excess of the
limits specified in this Subsection or established as hereinafter authorized
shall be lawful, but any speed in excess of the limits specified in this
Subsection or established as hereinafter authorized shall be prima facie
evidence that the speed is not reasonable or prudent and that it is iawfuh
The speed zones established by the Ordinance shall include SH 194 (Quincy
Street) from FM 3466 (Southwest 3rd Street) to US 70 (Sth Street) within the
corporate limits of the City of Plainview, Hale County, Texas; the maximum
legal speed shall be as follows:
Beginning at the north edge of FM 3466 (Southwest 3rd Street)
and extending northerly for a distance of 0.553 miles to the
south edge of US 70, the maximum legal speed for both northbound
and southbound traffic shall be 50 Mt)H;

and all Ordinances and parts of Ordinances in conflict herewith are hereby
repealed.
Section 2.
Any person violating any of the provisions of this Ordinance shall, upon
conviction thereof, be fined in any sum not less than Ten Dollars ($10.00),
nor more than Two Hundred Dollars ($200.00).
Section 3.
That the hazards and dangers to public health and safety create a necessity
requiring all rules providing that no Ordinance shall be finally passed on the
day of its introduction be suspended; and this Ordinance is declared to be an
emergency measure, to take effect from and after the date of its first
publication.
