HomeMy WebLinkAbout92-2896100 Amendment - Ambulance Rates ORDINANCE 92-2896 AN ORDINANCE OF THE CITY OF PLAINVIEW, TEXAS AMENDING CHAPTER FOUR, "AMBULANCES" OF THE CODE OF ORDINANCES OF THE CITY OF PLAINVIEW, TEXAS, ESTABLISHING RATES FOR AMBULANCE SERVICE TO THE PROPOSED STATE PRISON; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A CUMULATIVENESS CLAUSE; PROVIDING A CONFLICT CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Plainview, Texas, by and through its. City Council has the authority to govern and regulate the permitted uses of its streets and public ways; and WHEREAS, the City of Plainview, Texas, has the right, duty and obligation to protect and regulate ambulance services occurring within its corporate limits, as such are governmental functions of as set forth in ~ 101.0215 (2) of the Civil Practice and Remedies Code; and WHEREAS, the Plainview City Code, ~ 4-3, "Rates", currently sets that maximum rates which may be charged by an ambulance service operating within the corporate limits of the City of Plainview pursuant to a franchise; and WHEREAS, the City Council of the City of Plainview, Texas, has determined, after reviewing and hearing the evidence, that an addition in the allowable rates is in the best interest of the City of Plainview and its citizens; NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Plainview, Texas that ~ 4-3, Chapter 4, "Ambulances, of the Code of Ordinances of the City of Plainview, Texas, is hereby amended to read as follows: SECTION I. Sec. 4-3. Rates. A) Non-emergency Base Rate $ 85.00 B) Emergency Base Rate, including $125.00 the following: c) 1. Emergency Run (Code 3) 2. Emergency Run (Code 3-Codel) 3. Night Call 4. Intubation 5. IV Therapy 6. Cardiac Monitor Oxygen $ 20.00 1 of 3 101 D) Mileage, from station to patient $ 2.50/mile point of destination E) Mileage for return trip (patient mile) $ .50/mile F) Waiting Time (no charge for first 30 minutes) 20.00/half hour G) Rate for second patient when both $ 25.00 from the same household, if medical attention needed H) Call-Medical Attention Only $ 50.00 Requested; No Transport I) All non-reusable medical supplies Recommended retail cost Sec. 4-4. State Prison Rates. The City of Plainview shall provide advanced life support emergency services for the state prison facility at the following rates: Up to twenty (20) E.M.S. runs over the first two (2) year period, beginning on the date the facility begins accepting inmates, will be made at no charge; thereafter, rates charged will equal those set out in section 4-3 of this chapter. SECTION II. Severability. If any section, subsection, sentence, clause, phrase, of portion of this ordinance is, for any reason, held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct, and independent provision and such holding shall not affect the validity of the remaining provisions thereof. SECTION III. Cumulativeness. Provisions of this ordinance are cumulative and nothing herein shall prevent, alter, or diminish the applicability or enforcement of other ordinances restricting, regulating, or governing the subject matter herein. SECTION IV. Conflicts Ail Ordinance or portion of any ordinance of the City of Plainview, Texas, in conflict herewith, are hereby amended to conform with the provisions hereof. 2 of 3 102 SECTION V. Effective Date. This ordinance shall be of full force and effect upon its passage and publication as required by law. PASSED AND APPROVED this the 28th day of January, 1992. E.V.
