HomeMy WebLinkAbout92-2897103 Utilities - State and Federal Prison Rates ORDINANCE NO. 92-2897 AN ORDINANCE OF THE CITY OF PLAINVIEW, TEXAS, AMENDING CHAPTER TWENTY-FOUR, "UTILITIES" OF THE CODE OF ORDINANCES OF THE CITY OF PLAINVIEW, TEXAS, TO ADD A PROVISION FOR STATE PRISON RATES; SEVERABILITY CLAUSE; CUMULATIVENESS CLAUSE; CONFLICT CLAUSE; AND EFFECTIVE DATE. WHEREAS, there is a need to provide utilities to the proposed state prison; and WHEREAS, there is a need to provide special rates for the state prison. NOW, THEREFORE, BE IT ORDAINED by the City Council of Plainview, Texas that changes/additions to Chapter Twenty-four, entitled "Utilities" of the Code of Ordinances of the City of Plainview, Texas occur as set forth herein. SECTION I. Amendment. The following Code provisions follows: are amended to read as Sec. 24-44. Water Rates, Billings. (c) State and Federal Prison Rates. The City shall charge ninety cents ($.90) per one thousand (1000) gallons for water furnished by the City to the prison facility. This rate is guaranteed for five (5) years, said period to begin after the facility begins to accept inmates; thereafter, charged rates will be equal to the rates charged commercial customers inside the City limits. Sec. 24-45. Monthly Sewer Rates. (f) State and Federal Prison Rates. The rates to be charges for sewer service to the prison facility shall be as follows: Forty-four cents ($.44) per one thousand (1000) gallons. The rate is guaranteed for five (5) years, said period to commence after the facility begins accepting inmates; thereafter, charged rates shall equal rates charged to commercial customers inside the City limits. Sec. 24-47. Refuse collection fees; water termination. If any section, subsection, sentence, clause, phrase, or portion of this ordinance is, for any reason, held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct, and independent provision and such holding shall not affect the validity of the remaining provisions thereof. SECTION III. Cumulativeness. Provisions of this ordinance are cumulative and nothing herein shall prevent, alter, or diminish the applicability or enforcement of other ordinances restricting, regulating, or governing the subject matter herein. SECTION IV. Conflict. Ail ordinances or portions of any ordinance of the City of Plainview, Texas in conflict herewith, are hereby amended to conform with the provisions hereof. SECTION V. Effective date. 2 of 3 This ordinance shall be of full force and effect upon its passage and publication as required by law. PASSED AND APPROVED this 28th day of January, 1992. E.V.
