WHEREAS, the City Council of the City of Plainview has determined that it is
in the best interest of the public that changes and]or additions to Chapter
Five of the Plainview City Code relating to animal control occur as set forth
herein.
NOW, THEREFORK, BE IT ORDAINED by the City Council of the City of
Plainview, Texas that Chapter Five of the Plainview City Code be hereby
amended in the following manner:
SECTION 1: The following Sections of the Code of the City of Plainview are
hereby amended to read as follows:
Section 5-51. MINIMUM LENGTH FOR CHAIN OR TETHER
If a dog is chained or tethered within the corporate limits of the City,
the chain, rope, cable or other restraint device must be a minimum of six (6)
feet in length. The restraint device must be attached to a comfortable collar
around the dog's neck. The restraint device must not be so heavy as to
impede the movement of the animal.
Section 5-91. TIME FOR REDEMPTION
All impounded anim~ls shall be redeemed within seventy-two (72) hours
after the same was impounded. Any such animal not redeemed within such
time will be humanely destroyed or donated to the local Humane Society.
When calculating the seventy-two (72) hour period for redemption, hours
occurring on days when the animal shelter is not open for business Will not
be accrued to the redemption period, as long as space is available to hold the
impounded animals. If all animal shelter cages become full, the Humane
Society office manager and the supervisor of animal control will agree on
which untagged animals will be eutbanized, so that space can be made
available for additional animais.
Section 5-123. QUARANTINE OF SUSPECTED ANIMAL
Any animai which bites or scratches a person or which otherwise gives
symptoms of having rabies shall be immediately reported to the county health
officer and shall thereupon be securely quarantined at the direction of the
health officer, for a period of ten (10) days, and shall not be released from
such quarantine except by written permimsion of the health officer or under
his direction. The county health officer may designate the director of police
services to act in his place at any time. At the discretion of the health
officer, such quarantine may be on. the premises of the owner, at the shelter

designated as the city pound, or at the owner's option and expense, in a
veterinary hospital of his choice. In the case of stray arimals, or in the
cases of animals whose ownership is not known, such quarantine shall be at
the shelter designated as the city pound.
SECTION 2. Should any section, paragraph, sentence, clause, phrase, or
word of this ordinance be declared unconstitutional or invalid for any
purpose, the remaiuder of this ordinance shall remain unaffected thereby.
SECTION 3. This ordinance shall be effective upon its lawful passage and as
allowed by law.
