ORDINANCE NO, 92-29~6
AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF PLAINVIEW, TEXAS PROVIDING FOR
MUNICIPAL REGULATION OF MEETINGS ON PUBLIC
PROPERTY; SEVERABILITY CLAUSE; CONFLICTS
CLAUSE; AND EFFECTIVE DATE.
WHI~REAS, the City of Plalnview recognizes a measure of regulation with
regard to meetings on public property.
NON THEREFORE, be it ordained by the City Council of the City of
Plainview, Texas that :
Section I. Meetings on public property.
It shall be unlawful to hold any outdoor meetings FOR THE PURPOSE OF
EXPRESSIVE ACTIVITY on public property or conduct a processional parade,
unless a permit for such event has been issued by the Chief of Police.
(1) Application for USE OF A PARK FOR A RALLY, MEETING
OTHER EXPRESSIVE ACTIVITY shah be made to the parks and
recreation department at least five (5) days prior to the events, with a
copy sent to the police department and shall contain the following
information:
(A) A description of the event;
(B) The day of the event;
(C) The hours the event will start and terminate;
(D) Location of the event;
(E) A reasonable and good-faith appro~mation
of the number of persons expected to
attend the event;
(F) The names and addresses of the persons
sponsoring the event.
(G) Any additional information which the Chief of Police shall find
reasonably necessary to make a fair determiniation as to whether a
permit should be issued.
(2) The application for a parade permit shall be submitted to the Chief
of Police within ten (10) days prior to the event and shah set forth the
following information:
(A) The name, address, and telephone number of the person
seeking to conduct such parade;

(B) If the parade is proposed to be conducted for, on behalf of ,
or by an organization, the name, address, and telephone number
of the organization, and of the authorized and responsible heads of
such organization;
(C) The name, address, and telephone number of the person who
will be the parade chairman and who will be responsible for the
parade conduct;
(D) The date when the parade is to be conducted;
(E) The route to be traveled, the starting point, and the
termination point;
(F) The approximate number of persons who, and animals and
vehicles which, will constitute such parade, the type of
animals and the description of said vehicles;
(G) The hours when such parade will start and terminate;
(H) A statement as to whether the parade will occupy all or only
a portion of the width of the streets proposed to be traversed;
(I) The location by streets of any assembly areas for such
parade;
(J) The time at which units of the parade will begin to assemble
at any such assembly area or areas;
(K) The interval of space to be maintained between units of such
parade;
(L) If the parade is designed to be held by and on behalf of or
for any person other than the applicant, the applicant for such
permit shall file with Chief of Police a communication in writing
from the person proposing to hold the parade, authori~.ing the
applicant to apply for the permit on his behalf; and
(M) Any additional information which the Chief of Police shall find
reasonably necessary to make a fair determination as to whether a
permit should be issued.
(3) If the proposed rally, meeting, or parade does not comply with the
rules and regulations for the City of Plainview or the rules and
regulations for parades, the Chief of Police may present alternative
locations, times, routes, or other conditions that will comply. The
applicant can either accept the Police Chief's changes or submit a new
application within forty-eight (48) hours of the event that does comply
with the issues raised by the Police Chief.

(4) Upon compliance with this section, a permit shall be issued by the
Chief of Police.
Section II. Seve~-ability.
If any provision of this ordinance or the application thereof to any
person or circumstances is held invalid, the remainder of the ordinance and
the application of provisions to other persons and circumstances shall not be
affected hereby.
Section III. Conflicts.
If any of the provisions of this ordinance or the application thereof to
any person or circumstance is in conflict with another provision or ordinance,
the provisions set forth in this ordinance shah prevail.
Section IV. ]~"fective Date.
