HomeMy WebLinkAbout92-2907129 ZONE CASE NO. 582 - City of Pl-lnview - Special Events ORDINANCE NO. 92-9207 AN ORDINANCE AMENDING ZONING ORDINANCE NO. 89-2798; PROVIDING FOR AN AMENDMENT BY ADDITION TO SECTION 40, "SCHEDULE OF FEES, CHARGES, AND EXPENSES"; PROVIDING FOR A CUMULATIVENESS CLAUSE;~ PROVIDING FOR A CONFLICTS CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the proposed change in the Zoning Ordinance as herein after made bas been duly presented to the Planning and Zoning Commission for its recommendation which was received by the City Council and after due consideration, the. City Council of the City of Plainview finds that for the orderly grow-th of the City making the proposed change as hereinafter set forth will be in the public interest which creates an emergency; and WHEREAS, ali conditions precedent, required by law for a valid amendment to the Zoning Ordinance, have been fully complied with, including but not limited to, giving notices as provided by Local Government Code § 211.006 and §211.007; and WHEREA~, notice of time and place of this public hearing was published in the Plainview Daily Herald before the 15th day prior to the hearing date; and WHEREA~, said hearing was held in the City Council Chambers of the City Hall, Plainview, Texas, at which time persons appeared in support of the proposal; and after said hearing, it was determined by the City Council that it would be in the public ,interest to, due to changed conditions, amend the zoning ordinance in the manner hereinafter set forth in the body of this Ordinance; NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Plainview, Texas that: SECTION I. Sec. 40. Schedule of Fees, Charges, Expenses, and Regulation for Special Events. 40.1. The City Council .sba11 establish a schedule of fees, charges and expenses, and a collection procedure for building permits, certificates of zoning compliance, appeals and other matters pertaining to this ordinance. The Schedule shall be posted in the office of the aclministration official and may be altered or amended only by the City Council. 40.2. No permit, certificate, special exception, or variance shall be issued unless and until such costs, charges, fees, or expenses listed below have been paid in full, nor sl~atl any action be taken on proceedings before the Zoning Board of Adjustment unless or until pre1iminary charges and fees have been paid in full. 1 of 2 130 40.3. The exact charge for the fOllowing services will be established as indicated: Docketing a zoning petition with the Planning and Zoning Commission of the City of Plainview requires a separate ordinance. be Docketing an .application for relief with the Zoning Board of Adjustment of the City of Plainview requires a separate ordinance. Permitting fees for special events (as described in Sec. 9.5, subsection 5.2c) sb~all be Fifty Dollars ($50.00). 40.4. Regulation and permitting procedures for special events shall be defined by the City Manager or his/her designee. Section II. A notice that a public hearing sba11 be held in the Council Chambers of the City Hall in Plainview, Texas, at 7:30 p.m. on the 10th day of March, 1992, to permit the public to be heard prior to consideration of the Ordinance was published in the Plainview Daily Herald, a daily newspaper of general circulation in the City of Plainview, Texas, said publication being more than fifteen (15) days prior to the time designated for said hearing. Section III. Cumulativeness Clause Provisions of this ordinance are cumulative and nothing herein shall prevent, alter or diminish the applicability or enforcement of other ordinances restricting, regulating or governing the subject matter herein. Section IV. Conflicts. All ordinances or portions of any ordinance of the City of Plainview, Texas in conflict herewith, are hereby amended to conform with the provisions hereof. Section V. Effective Date. This ordinance shall be of full force and effect upon its passage and publication as required by law. PASSED AND APPROVED this the 10th dav of March, 1992. E.V.
