HomeMy WebLinkAbout92-2909135 AMENDMENT - TRAFFIC CODE ORDINANCE NO. 92-2909 AN ORDINANCE OF THE CITY OF PLAINVIEW, TEXAS, AMENDING THE PLAINVIEW CITY CODE, CHAPTER 23, ARTICLE XIV, ENTITLED "STOPPING, STANDING, AND PARKING." WHEREAS, the Traffic Code of the City of Plainview has not been amended since 1991; and WHERF~AS, the City of Plainview recognized the needs of our Handicapped Citizens and in so doing recognizes a need to update the Traffic Code to conform to existing conditions. NOW THERI~FORE BE IT ORDAINED, by the City Council of the City of Plainview that Chapter 23, Article XIV of the Plainview City Code is hereby amended to read as follows: Section 23-382 A. Implementation of a program to allow our Handicapped Parking Citizens to enforce Handicapped Parking Violations under the directions of the Director of Public Safety. B. Whenever a volunteer under the jurisdiction of the Handicapped Enforcement Specialist Program of the City of Plainview shall observe any motor vehicle in violation of Municipal Code 1957, Ch. 14, ss6?, that volunteer shall have the authority to attach to such vehicle a parking ticket, which shall be directed to the owner of such vehicle, and shah set forth the nature of the violation. Any such citations shall be treated in the same manner as a citation issued by any Police Officer or Public Safety Employee of the City of Plainview. Ref: State Law 6675a 5e.1, Sec. 6A (d), Sec. 10 (b) Section 2 That should any section, p~ragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. Section 3 That any person, firm or corporation violating the aforesaid Section 23-382 as herein after amended shall, upon conviction be fined any sum not to exceed Two Hundred Dollars ($200.00). Section 4 That the City Secretary is authorized and directed to cause the i of 2 136 publication of the descriptive caption of this Ordinance together with the penalty provision as an alternative method of publication as provided by law.
