HomeMy WebLinkAbout92-2910137 ZONING ORDINANCE - AMENDMENT ORDINANCE NO. 92-2910 AN ORDINANCE AMF~IDING THE ZONING ORDINANCE NO. 89-2?98; PROVIDING FOR AN AMEND~L~T TO § 9:5 , RETAIL AND SERVICE TYPE USES; PROVIDING FOR A CUMULATIVENESS CLAUSE; PROVIDING FOR A CONFLICTS CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE WHERF_~kS, Ordinance No. 89-2798, known as the City of Plainview Zoning Ordinance, sets forth the zoning districts and corresponding map for the City of Plainview in accordance with state law; and WHERF_~S, Ordinance and update such; and to review the Zoning WHEREAS, it is found to be in the best interests of 'the City of Plainview to amend the following section; NOW, THEREFORE, BE IT ORDAINED, by the City Council of the City of Plalnview, Texas that following section be amended, by way of addition, to read as follows: Section 1: § 9: 5. RETAIL AND SERVICE TYPE UiSES 5.2c. AMUSEMENT, TEMPORARY COMMERCIAL (Outdoor) Any area or structure described in § 5.2b that will have a duration of 14 days or less which has been approved administratively by the City Manager or his ! her designee. Section II. A notice that a public hearing shall be held in the Council Chambers of the City Hall in Plainview, Texas, at 7:30 p.m. on the 25th day of February, 1992, to permit the public to be heard prior to consideration of the Ordinance was published in the Plainview Daily Herald, a daily newspaper of general circulation in the City of Plainview, Texas, said publication being more than fifteen (15) days prior to the time designated for said hearing. Section III. Cumulativeness Clause Provisions of this ordinance are cumulative and nothing herein shall prevent, alter or diminish the applicability or enforcement of other ordinances restricting, regulating or governir~g' the subject matter herein. 1 of 2 138 Section IV. Conflicts. All ordinances or portions of any ordinance of'~,the City of Plainview, Texas in conflict herewith, are hereby ~mended to conform with the provisions hereof. Section V. Effective Date.
