HomeMy WebLinkAbout02 0709 min76 The Plainview City Council met on July 9, 2002 at 7:00 p.m. in the City Council Chambers of the Plainview City Hall at 901 Broadway. The agenda for this meeting was posted in City Hall at 10:00 a.m. on July 2, 2002. Mayor Lloyd C. Woods presided. Councilmembers present were: Kelvin Tipton-District 1, Mary Jane Shanes-District 2, Belinda Pena-District 3; Ross Owen-District 5, and Buddy McGehee-District 6. John N. Bertsch-District 4 and Irene Favila-District 7 were absent. Staff members present were: James P. Jeffers-City Manager; Elizabeth Regner- Assistant City Manager; Dale Simpson-Civil Service Director; John Berry-Director of Public Works; Wally Hatch-City Attorney, John Castro, Director of Community Services, Will Mull-Chief of Police, Gary Glass-Fire Chief, Jason Thompson-Interim Main Street Coordinator and Belinda Hinojosa-City Secretary. News Media Representative: Richard Orr-Plainview Daily Herald Guests present were: Joe Ed Sullivan, Brenda Coleman, Dwain Dodson, Keith Billington, P. C. Annett, Victor A. Gutierrez Councilmember Pena delivered the invocation. Wally Hatch, City Attorney led in the Pledge of Allegiance. Councilmember McGehee moved to adopt the consent calendar. The motion was duly seconded by Councilmember Shanes and carried by unanimous vote. Items approved on the Consent Calendar included: approval of the minutes of June 25, 2002; receipt of departmental reports; approval of expenditures and granting an excused absence to Councilmembers Bertsch and Favila. The Council approved upon second reading Ordinance No. 02-3339, an Ordinance of the City Of Plainview Amending Ordinance No. 01-3300 to Appropriate Funds in the General Fund in the 2001 - 2002 Budget to Supplement Funds in Animal Control Building Maintenance, Shop Equipment and Heating and Cooling; Cumulativeness Clause; Conflicts Clause; Severability Clause; And Effective Date. This budget amendment is in the amount of $1,930 to cover necessary expenditures for building maintenance, shop equipment, and heating and cooling. The Council approved the reappointment of Dr. Kit Linton to the Plainview/Hale County Health Advisory Board. The Council approved the signing of the Bioterrorism Grant Contracts with the Texas Department of Health. The Council approved the appointment of Nell Mayfield to the Coordinating Board of Economic Development. The Council approved upon first reading Ordinance No. 02-3341, an Ordinance of the City of Plainview Amending Ordinance No. 01-3300 to Appropriate Funds in the Street Improvement Fund in the 2001-2002 Budget to increase Street Improvements fund for the Street Department. The Council approved street repairs totaling $462,440.00 which includes paving 11th Street from. Quincy to Canyon, paving 18th Street from Jefferson to ~ block west, valley gutter repair from 10th & Utica, 8th & Utica, 15th & Galveston, 24th & Kokomo, 18th & Smythe, 9th & Utica, 20th & Kokomo and 6th & Raleigh. The Council approved upon first reading Ordinance No. 02-3338, an Ordinance Amending Ordinance No. 01-3300 to Appropriate Funds in the 2001-02 Budget For The Advanced Level Of Training. The Council approved the signing of the Memo of Understanding Relating to the ITS Integration Process by The Texas Department of Transportation, City of Plainview et al. The Council approved Ordinance No. 02-3340, an Ordinance of the City of Plainview, Texas, amending section 24-158 of the Code of Ordinances to establish a maximum rate of speed for vehicles traveling City of Plainview Minutes July 9, 2002 Page 1 of 3 Northbound and Southbound on Andy Taylor Road; proViding for a penalty; cumulativeness clause; conflicts clause; severability clause; and effective date. This ordinance changes the speed limit on Andy TaYlor Road to 40 miles per.hour. The Mayor presented Ordinance No. 02-3335, an Ordinance Amending the Zoning Map of the City of Plainview, Texas for Rezoning of Lot 2, Block 1 Checker Subdivision, Being Portion of Block 86, College Hill Addition From Commercial General Business (C- 3) Zoning District to a Multi-Family (MF-2) Zoning District, Plainview, Hale County, Texas CumulatiVeness Clause; Conflict Clause; Severability Clause; and Effective Date. V. Gutierrez - 400-500 Block of Canyon There was no public comment. Upon questioning from Councilmember Shanes, Dr. Victor Gutierrez whose address is PO Box 1809, Plainview advised he hoped to construct 25 apartment buildings. Councilmember Shanes moved that Ordinance No. 02-3335 be approved upon second reading. The motion was duly seconded by Councilmember Owen and carried by unanimous votel Mayor Woods advised the Council that requests had been received from the Masons and Elks for a tax exemption. The Texas Legislative authorized taxing jurisdictions to give property tax relief to organizations that provide specific charitable services. Joe Ed Sullivan of 1315 Borger representing the Masons from Arch Keys LOdge 1395 and Plainview Lodge 709 stated their tax exemption amount would be $163.57. The Masons contribute $2 million a day nationally. Brenda Coleman of 2612 West 19th Street representing the Elks Lodge stated their organization contributes $3 to $5 million a day nationwide. She stated they were not able to pay their assessment this year and need the tax relief. P. C. Annett of 815 Portland stated the Elks Lodge assists Meals on Wheels, Special Olympics and that they are a non-profit organization. City Attorney Wally Hatch stated each organization would need to file a request for tax exemption every five years. Mayor Woods moved the Council approve Resolution R02-110, a Resolution of the City Council of the City of Plainview, Texas Establishing Property Tax Relief to Organizations That Provide Specific Charitable Services, Making Them Available to Qualified Organizations, Pursuant to Taxable Property And Exemptions (Chapter 11 of the Texas Tax Code). The motion was duly seconded by Councilmember Pena and carried by unanimous vote. The closed session to discuss economic development for a cheese manufacturing operation was not held. Mayor Woods moved the meeting be adjourned.
