HomeMy WebLinkAbout92-29258 2 ZONE CASE NO. 589 - Rob Wink~er om-behalf of Calvary Church ORDINANCE NO. 92-2925 AN ORDINANCE AMENDING ZONING ORDINANCE NO. 89-2798 AND THE ZONING MAP OF THE CITY OF PLAINVIEW SO AS TO MAKE THE FOLLOWING CHANGES: WHEREAS, the proposed change in the Zoning Ordinance as hereinafter made has been duly presented to the Planning and Zoning Commission for its recommendation which was received by the City Council and after due consideration, the City Council of the City of Plainview finds that for the orderly growth of the City making the proposed change as hereinafter set forth will be in the public interest which creates an emergency; and WHEREAS, all conditions precedent, required by law for a valid amendment to the Zoning Ordinance, have been fully complied with, including but not limited to, giving notices as provided by Local Government Code ~ 211.006 and ~ 211.007; and WHEREAS, notice of time and place of this public hearing was published in the Plainview Daily Herald before the 15th day prior to the hearing date; and WHEREAS, said hearing was held in the City Council Chambers of the City Hall, Plainview, Texas, at which time persons appeared in support of the proposal; and after said hearing, it was determined by the City Council that it would be in the public interest to, due to changed conditions, amend the zoning ordinance in the manner hereinafter set forth in the body of this Ordinance; NOW, THEREFORE~,~,BE~iIT'~ORDAINED by the City Council of the City of pl~a'i~,'~eXas?~'that: Section I. Request of Rob Winkler on behalf of Calvary Church, to rezone from a R-1 (Single-Family Residential District) Zoning District to a C-2 (Light Retail and Commercial District) Zoning District for use as ministry and educational facilities and generally located on the East side of Interstate 27 in the 100 & 200 Blocks and described as being a 6.387 acre tract out of the west part of a 28.22 acre tract out of the southeast part of Survey No. 28, Block JK-2, Hale'County, Texas recorded in Vol. 783 p. 243 and a contiguous 10.0 acre tract out of the Southeast Quarter of Section 28, Block JK-2, Hale County, Texas recordedm in Vol. 556 p. 159. Section II. A notice that a public hearing shall be held in the Council Chambers of the City Hall in Plainview, Texas, at 7:30 p.m. on the 14th day of July 1992, to permit the public to be heard prior to consideration of the Ordinance was published in the Plainview Daily Herald, a daily newspaper of general circulation in the City of Plainview, Texas, Said publication being more than fifteen (15) days prior to the time designated for said hearing. Cumulativeness Clause PrQvisions of this ordinance are cumulative and nothing herein shall prevent, alter or diminish the applicability or enforcement of other ordinances restricting, regulating or governing the subject matter herein. Section IV. Conflicts. Ail ordinances or portions of any ordinance of the City of Plainview, Texas in conflict herewith, are hereby amended to conform with the the provisions hereof. Section V. Effective Date. This ordinance shall be of full force and effect upon its passage and publication as required by law. PASSED AND APPROVED this the 14th day of July, 1992. E. V.
