HomeMy WebLinkAbout92-2940215 ZONING ORDINANCE - AMENDMENT ORDINANCE NO. 92-2940 AN ORDINANCE AMENDING THE ZONING ORDINANCE NO. 89-2798; PROVIDING FOR AN AMENDMI~v]~ TO SECTION 8.1, SCHEDULE OF USES ESTABLISHED TO INCLUDE ADULT DAY CARE CI~I~]~; PROVIDING FOR AN AMENDMENT TO SECTION 8:3 TO INCLUDE THE DEFINITION OF AN ADULT DAY CARE CENTER; PROVIDING FOR AN AMENDMi~IT TO SECTION 9.2 TO INCLUDE DEFINITION OF ADULT DAY CARE CENT]~R; CLrMIILATIVENESS CLAUSE; CONFLICTS CLAUSE; SEVERABrt. ITY 'CLAUSE; AND EFFECTIVE DATE. WHERF~S, Ordinance No. 89-2798, known as the City of Plainview Zoning Ordinance, sets forth the zoning regulations, zoning districts and corresponding map for the City of P]ainview in accordance with state law; and WHEREAS, from l~me to time it is advisable to review the Zoning Ordinance and update such; and WHEREAS, notice of a public hear]ng to discuss an amendment to Sections 8:1, 8: 3, and 9: 2 of the Zoning Ordinance was published in the Plalnview Daily Herald before the 15th day prior to the hearing date; and WHEREAS, said hearing was held in the Council Chambers of the City Hall, Plalnview, Texas, at which time persons appeared in support of the proposal; and WHEREAS, the proposed change in the Zoning Ordinance as herein after made has been duly presented to the Planning and Zoning Commi.~sion for its recommendation which was received by the City Council; and WHEREAS, it was determined by the City-Council that it would be in the best public interest to, due to changed conditions, amend the zoning ordinance in the manner hereinafter set forth in the body of this Ordinance; NOW, THEREFORE, BE IT ORDAINED, by the City Council of the City of Plainview, Texas that: SECTION I 8:1. Adult day care centers shall be located adjacent to a street having pavement width of thirty-six (36) feet or greater. 2. Site plan approval by the Planning and Zoning Commission shall be required for all adult day care center sites, whether or not a Specific Use Permit is required. 3. Ail adult day care centers shall comply with the following standards: a. Ail vehiculA- entrances and exits sbA11 be clearly visible from the street, b. Ail passenger loading and unloading areas shall be located so as to avoid safety hazards from vehicular tr~affic and adequate walkways sbAll be provided~ 4. Excepting the provision of this section 8.3.11, all minim~,m standards of the Texas Department of HumAn Resources relative to adult day care centers are hereby incorporated into this ordinance. SECTION III 9:2 EDUCATIONAL~ INSTITUTIONAL AND SPECIAL USES 2.0. ADULT DAY CARE CENTER. An adult day care facility providing care, training, education, custody, treatment or supervision for less fhAn 24 hours per day. The term "adult day' care center" shall include medical treatment, counseling, or rehabilitative services, but sbA11 not include .overnight lodging. Site plan approval by the Planning and Zoning Commission and City Council shall be required for all adult day care center sites. SECTION IV Provisions of this ordinance are cumulative and nothing herein sbA11 prevent, alter, or dimiuish the applicability or enforcement of other ordinances restricting, regn~lAting or governing the subject matter herein. SECTION V Ail ordinances or portions of any ordinance of the City of P1Ainview, TexAs in conflict herewith, are hereby Amended to conform with the provisions hereof. (Page 2 of 3) 217 SECTION VI Should any section, subsection, or any portion hereof be deemed invalid for any reason, such holding shall not render or invalidate any other section, sub-section, sentence, provision, clause, phrase, or word severable therefrom and the same shall be deemed severable for this purpose. SECTION VII This ordinance shall be of full force and effect upon its passage and publication as requi~ed by law. PASSED AND APPROVED this the ATTEST: E.V.
