TO SAFEGUARD LIFE, HEALTH, PROPERTY AND PUBLIC WELFARE BY REGULATING THE STORAGE, -USE AND HANDLING OF DANGEROUS, AND HAZARDOUS MATERIALS, SUBSTANCES AND .PROCESSES, AND BY REGULATING THE MAINTENANCE OF ADEQUATE EGRESS FACILITLES, PROVIDING FOR. THE REPEALING OF ORDINANCE NO. 82-2497 OF THE CITY OF PLAINVIEW, PROVIDING FOR' ADOPTION OF THE UNIFORM FIRE CODE, 1985 EDLTION, AS COPYRIGHTED IN 1.985.; THE INTERNATIONAL CONFERENCE OF BUILDING OFFICIALS OF WHITTIER, CALIFORNIA, PROVIDING FOR CERTAIN AMENDMENTS THERETO; PROVIDING :PENALTIES FOR THE VIOLATION THEREOF; PROVIDING A SEVERABLILITY CLAUSE; DIRECTING PUBLICATION OF THE DESCRIPTIVE CAPTION OF THIS ORDIN'ANCE,. TOGETHER WITH THE PENALTY PROVISIONS,`AND PROVIDING'AN EFFECTIVE BATE OF THIS ORDINANCE. WHEREAS, the City Council of the City of Plainview finds that the present Fire Code of the :City of Plainview is inadequate to properly protect the public health, safety, and welfare of the citizens of the City of Plainview and their property, from loss due to fire, and WHEREAS, the City Council appointed the Fire Code Board of. .' ~, Appeals to prepay:e recommendations for the City.. Council in regard to a new Fire Code; .and WHEREAS, the Fire Code Board of Appeals, recommends the Uniform Fire Code, 1985 Edition, with certain. amendments thereto, be adopted as the Fire. Code of the City of Plainview; NOW, THEREFORE: BE 3T ORDAINED BY THE CITY COUNCIL OF THE CITY OF PLAINVIEW, TEXAS: SECTION 1. SECTION 2. That the 1982 Edition of•the.Uniform Fire Code, as copyrighted in 1982 by-the International Conference of Building Officials of Whittier, .California (being Ordinance No-, 82-2497 of the City of Plainview) be and the same is hereby-repealed. That the, 1985 Edition of the Uniform Fire. Code, as copyrighted in 1985 by-the International Conference of Building Officials of Whittier, California, as `hereinafter amended is specifically adopted as the Fire .Code of the City of -Plainview, Texas, and a copy is attached hereto and incorporated herein by reference as though set out completely in detail. A copy of said Uniform Fire Code shall be filed with the City Secretary and a copy maintained in the"office of the Fire Marshal_of the City of Plainview, Texas. All such copies to be open to public inspection during business hours of the office. where they are maintained, ~, with the fol owing amendments thereto: r`~, . SECTION 3. That Part I, Article 2, Division III, Section 2.303(b) of the Uniform Fire Code,..1985 Edition, shall be and the same is hereby. amended by addition to ..the list. of : recognized Standards as part'. of the list, the 1985 Edition- of the "Life Safety Code"', N.F.P. A. 101 as copyrighted in 1985.' SECTION 4. That .Part I, Article 4, Section 4.101 of the Uniform Fire Code,: 1985 Edition, shall be and the same is herebyameded by deleting requirements for permit No permit` .shall be requred when' referred to 'in the' code. SECTION 5. That Part II, Article 9, Seet-ion 9.123 of the Uniform Fire' Code, 1985 Edition, shall be and the same is hereby.:amended.to read as follows: When .reference is made to the Uniform Mechanical Code, it shall be deleted. SECTION 6. That Part I, Article 2, Division I of the Uniform Fire Code, 1985. Edition, is hereby amended. by adding thereto a section to be known as Section 2.110 which said section shall read as follows: That the entire incorporated area of the City of i .Plainview is hereby declared to be and is hereby established as a fire district, and said fire district shall be known and designated as Fire Zone 1, 2, and 3, and each such 'zone-shall include such territory and portions of the'City of Plainview as follows: Zone 1 shat include the territory as set out and - described by metes and bounds as Zone 1..under Chapter 9, Article 1, Section 9.1{a) of the Municipal Code. of the City of-Plainview, as adopted-1978. . Zone 2 shall include the -territory as set out and described by metes and bounds as Zone 2 under Chapter 9, Article 1, Section 9.1(b) of the Municipal Code, City of Plainview, adopted 1978. It shall also include all commercial property and buildings now existing, and all. property that :may be zoned for commercial use. Zone 3 shallinclude all the area not set out in Zone 1 and Zone 2. - SECTION 7. That Part VII, Article 79, Division V, Section 79.501, of. the Uniform Fire.Code, 1985 Edition, shall be a.nd the same is hereby amended to read as 'follows:. The limits in which storage of flammable liquids in outside- above ground tanks is prohibited are hereby established ~` ` as follows:. a , d ~ ~ A. The limits in which. storage of Class Land Class II 'Liquids in outside above ground tanks is prohibited in any residential district, as set out by the Zoning Ordinance of the City of Plainview, as .amended. B. The limits in which new bulk plants for .Class I and Class II Liquid s are prohibited are those Zones. in the City of Plainview where such bulk plants are not permited by the Zoning Ordinance of the City of Plainview, as amended. SECTI0N.8. SECTION 9. PENALTIES: Any. person, firm, or corporation violating any of the provisions of this Code shall be deemed guilty of a misdemeanor, and each such person shall be deemed guilty of _a separate offense for each and every day or portion thereof during. which any violation of any of the provisions of this Code is committed., combined, or permitted, and upon the conviction of any such violation such person shall be punishable by a fine of not more than One Thousand Dollars ($1,000). SEVERABILITY CLAUSE: If any provisions of this. Ordinance or of the Code hereby adopted or the application thereof to any person - or circumstance is held invalid, the remainder of the Code and the application of such provisions to other persons or circumstances, shall not be affected hereby. SECTION 10. The City Secretary is hereby authorized-and directed to cause the publication of the descriptive Caption of this Ordinance together with the penalty provisions as provided herein.
