HomeMy WebLinkAbout11 0120 minThe City Council met on January 20, 2011, at the Plainview Convention Center, 2902 West 4 Street, Plainview, Texas. The agenda for this meeting was posted in City Hall at 11:26 a.m. on January 17, 2011. Mayor Pro Tem Roland Nash presided. Councilmembers present were: Charles Starnes - District 1, Cathy Waggoner- District 2, Virginio "V.O." Ortega- District 4, and Wendell Dunlap- District 6. Mayor Anderson, Councilmembers David Garcia - District 3, Ron Trusler were absent. Staff members present were: Greg Ingham -City Manager, Jeffrey Snyder- Assistant City Manager, Mike Gilliland- Director of Public Works, Leslie Pearce -City Attorney, Will - Mull- Police Chief, Sarianne Beversdorf- Director of Finance, Dale Simpson- Director of Civil Service, Philip Mize -Fire Marshal, Rusty Powers -Fire Chief, Delwin Derrick -Chief Building Official, and Belinda Hinojosa -City Secretary. News Media Present: Tommy Young, Plainview Daily Herald Mayor Pro Tem Nash led in the Invocation. Mayor Anderson, Councilmembers Garcia and Trusler were granted excused absences. Sarianne Beversdorf, Director of Finance presented for consideration the Quarterly Investment Report for the period from October 1, 2010 through December 31, 2010. In the demand deposits (checking accounts) the beginning book value is $13,780,955 and the ending book value is $21,541,804. The deposits are collateralized and earning 0.25% interest. In the investment portfolio, the beginning balance is $16,792,747 and the ending balance is $$18,834,057. Mayor Pro Tem Nash asked for public comment. There was no public comment. Councilmember Starnes moved to accept the financial report. The motion was duly seconded by Councilmember Waggoner and carried by unanimous vote. Mayor Pro Tem Nash presented for consideration on second reading Ordinance No. 11- 3540, an Ordinance Amending Chapter 11, Fire Protection and Prevention, of the City of Plainview Code of Ordinances; to Adopt the International Fire Code (2009 edition); Repealer; Cumulativeness Clause; Conflicts Clause; Severability Clause, and Effective Date. Since this was the second of two readings, the Council chose to forego the staff briefing and asked for public comment. There was no public comment. Councilmember Ortega moved approval of Ordinance 11 -3540 on second reading. The motion was duly seconded by Councilmember Dunlap and carried by unanimous vote. Mayor Pro Tem Nash presented for consideration on second reading Ordinance No. 11- 3541, an Ordinance Amending Chapter 10, Electricity, of the City of Plainview Code of Ordinances, to Adopt the National Electrical Code (2008 Edition); Repealer; Cumulative Clause; Conflicts Clause; Severability; and Effective Date. Since this was the second of two readings, the Council chose to forego the staff briefing and asked for public comment. There was no public comment. Councilmember Dunlap moved to approve Ordinance No. 11 -3541 on second reading. The motion was duly seconded by Councilmember Waggoner and carried by unanimous vote. City Council Minutes January 20, 2011 Page 1 of 3 471 472 Delwin Derrick, Chief Building Official presented for consideration on first reading Ordinance No. 11 -3542, an Ordinance Amending Chapter 20, Plumbing / Mechanical, of the City of Plainview Code of Ordinances to Adopt the International Plumbing Code (2009 Edition), the International Mechanical Code (2009 Edition), the International Fuel Gas Code (2009 Edition), and the NFPA 99C (2005 Edition), as Building Codes for the City of Plainview, Hale County, Texas Repealer; Cumulativeness Clause; Conflicts Clause; Severability Clause, And Effective Date. This ordinance upgrades the plumbing and mechanical codes. This adds an annual contractor registration with a $30.00 fee added to the mechanical registration. It also adds a section for medical gas and a section for fuel gas. This adopts the 2009 International Plumbing Code, the 2009 International Mechanical Code, the 2009 International Fuel Gas Code and the NFPA 99C Medical Gas Systems. Mayor Pro Tem Nash asked for public comment. There was no public comment. Councilmember Waggoner moved to approve Ordinance No. 11 -3542 on first reading. The motion was duly seconded by Councilmember Dunlap and carried by unanimous vote. Mayor Pro Tem Nash presented for consideration on first reading Ordinance No. 11- 3543, an Ordinance Amending Chapter 6, Buildings, of the City of Plainview Code of Ordinances to Adopt the International Building Code (2009 Edition), the International Residential Code (2009 Edition), the International Energy Conservation Code (2009 Edition), and the International Existing Building Code (2009 Edition), as Building Codes for the City of Plainview, Hale County, Texas; Repealer; Cumulativeness Clause; Conflicts Clause; Severability Clause, And Effective Date. This ordinance adds five permit fees as follows: (1) roofing permit fee - $45.00; (2) automatic fire extinguishing system - $45.00; (3) fire alarm system and related equipment - $45.00; (4) fire pumps - $45.00 and (5) standpipe system - $45.00. This adopts the 2009 International Building Code, the 2009 International Residential Code, the 2009 International Energy Conservation Code; the 2009 Existing Building Code and the Texas Accessibility Standards. It amends accessory building permits for structures form 120 sq. ft. to over 200 sq. ft and fences not over 8 feet in height. The ordinance also exempts one and two family dwellings from fire sprinkler requirements. It also adopts Chapter 11, Accessibility of the 2009 edition of the International Building Code and the Texas Accessibility Standards. The ordinance also deletes reference to the Life Safety Code and adopts the 2009 International Existing Building Code. It also amends the codes to incorporate the Building Trades and Fire Code Board of Appeals into the building codes. Mayor Pro Tem Nash asked for public comment. There was no public comment. Councilmember Starnes moved to adopt Ordinance No. 11 -3543 on first reading. The motion was duly seconded by Councilmember Waggoner. Councilmember Starnes asked what kind of criteria exists to issue a roofing permit. He was advised by Mr. Derrick that anybody installing a roof would need a permit. He asked what if someone was putting the roof over existing layers. Mr. Derrick advised that they would be limited to the number of layers on the roof. Mayor Pro Tem Nash, Councilmembers Waggoner, Ortega and Dunlap voted "for" the motion and Councilmember Starnes voted against. The Council and staff reviewed the agenda for the City Council meeting of January 25, 2011. Councilmember Dunlap moved to adjourn the meeting. The motion was duly seconded by Councilmember Ortega and carried by unanimous vote.
