HomeMy WebLinkAbout11 0208 minThe Plainview City Council met on February 8, 2011 at 7:00 p.m. in the City Council Chambers of the Plainview City Hall at 901 Broadway. The agenda for this meeting was posted in City Hall at 4:30 p.m. on February 4, 2011. Mayor John C. Anderson presided. Councilmembers present were: Charles Starnes District 1, Cathy Waggoner District 2, V. O. Ortega- District 4, Ron Trusler- District 5, and Wendell Dunlap- District 6. Councilmembers David Garcia District 3 and Roland Nash District 7 were absent. Staff members present were: Greg Ingham -City Manager, Leslie Pearce -City Attorney, Mike Gilliland- Director of Public Works, Will Mull Police Chief, Dale Simpson- Director of Civil Service, Rusty Powers -Fire Chief, Eric Turner -Main Street /CVB Coordinator, Sarianne Beversdorf- Director of Finance, Delwin Derrick -Chief Building Official, and Belinda Hinojosa -City Secretary. Guests Present: Kim Heyryeon News Media Present: Tommy Young, Plainview Daily Herald Councilmember Ron Trusler delivered the invocation and led in the Pledge of Allegiance. Mayor Anderson introduced Kim Heyryeon with the Republic of Korea. She is with the Fulbright Exchange Program. Mayor Anderson recognized Dale Simpson for his years of service to the City and thanked him for the super job he has done for the City of Plainview. Councilmember Dunlap moved to adopt the consent calendar. The motion was duly seconded by Councilmember Trusler and carried by unanimous vote. Items approved on the consent calendar included the approval of the minutes of January 25, 2011 and February 3, 2011 and the granting of excused absences to Councilmembers David Garcia and Roland Nash. Greg Ingham, City Manager presented for consideration Ordinance No. 11 -3544, an Ordinance of the City of Plainview, Texas Amending Chapter 19, Article V, Flood Prevention, of the Plainview Code of Ordinances, Establishing Updated Administrative Procedures For Flood Hazard Prevention in the City of Plainview; Designating the Local Floodplain Administrator; Adopting "The Flood Insurance Study for Hale County, Texas and Incorporated Areas Development Requirements; Repealer; Cumulativeness Clause; Conflicts Clause; Severability Clause; and an Effective Date. He provided background on how we got here. We started in September 2008 to update the flood plain maps. During 2009, FEMA and contractors worked thru process of updating data and study. The City asked for update in Frisco and Givens areas and FEMA denied that request. In February 2010, FEMA published notice of appeals period to make citizens aware that maps were being updated. On February 9, 2010 staff explained appeals process to Council and public. Maps were available for review online and at city hall. The folks in Grandview and 7th Parkway were notified of changes and the public was made aware and given the opportunity to participate in the process. FEMA had public hearing here and in County. The process is nearing the end. The City now has to adopt an ordinance to incorporate the new FEMA guidelines and formally adopt City Council Minutes February 8, 2011 Page 1 of 2 479 480 the new flood insurance study. Delwin Derrick, Chief Building Official reviewed the Ordinance. He stated the Texas Legislature has delegated the responsibility to local governmental units to adopt regulations designed to minimize flood losses. The ordinance adds 26 definitions, changes eight definitions and deletes three definitions. The Flood Insurance Study for Hale County, Texas and Incorporated Areas dated February 18, 2011 is adopted. The Chief Building Official is appointed the Floodplain Administrator. The ordinance lists the general standards for construction in flood areas and subdivision proposals and manufactured home subdivisions and parks. Mayor Anderson asked for public comment. There was no public comment. Councilmember Trusler moved to approve Ordinance No. 11 -3544 on first reading. The motion was duly seconded by Councilmember Waggoner. The motion carried by unanimous vote. Mayor Anderson moved to go into closed meeting to deliberate the appointment, employment, evaluation, reassignment, duties, discipline or dismissal of a public officer or employee, or to hear a complaint or charge against an officer or employee. [Tex. Gov't. Code, Section 551.074]. Appointments to the following boards and commissions: Main Street Program/Tourism Coordinating Board and Planning and Zoning Commission. The motion was duly seconded by Councilmember Starnes and carried by unanimous vote. Mayor Anderson recessed the meeting at 7:19 p.m. Mayor Anderson called the meeting back in open session at 7:33 p.m. Councilmember Ortega moved to reappoint Nicki Logan, Lydia Castillo and Beverly Wall to the Main Street Program/Tourism Coordinating Board with said terms to expire on January 1, 2013; and to appoint Kay Harris, Sammy J. VanHoose, Hari Krishna to the Main Street Program/Tourism Coordinating Board with said terms to expire on January 1, 2013; and to appoint Kenneth Hooper to the Main Street Program/Tourism Coordinating Board with said term to expire on January 1, 2012. The motion was duly seconded by Councilmember Starnes. There was no public comment. The motion carried by unanimous vote. Councilmember Trusler moved to appoint Kevin Sweeney to the Planning Zoning Commission with said term to expire on January 1, 2012; and to appoint Mark Hardin and Niler Pyeatt as alternates to the Planning Zoning Commission with said terms to expire on January 1, 2013. The motion was duly seconded Councilmember Dunlap. There was no public comment. The motion carried by unanimous vote.
