AN ORDINANCE OF THE CITY OF PLAINVIEW ESTABLISHING
A FUND FOR SELF-INSURANCE AGAINST PROPERTY AND
LIABILITY CLAIMS; PROVIDING FOR FUTURE ADDITIONS
TO SAID FUNDS; PROVIDING FOR ADMINISTRATIVE ACTION
ON CERTAIN CLAIMS AND EXPENDITURES RELATED TO
SELF-INSURANCE.
WHEREAS, the City Council of the City of Plainview
has determined it to be in the best interest of the City
to be partially self-insured in numerous areas; and
WHEREAS, the City Council of the City of Plainview,
Texas hereby expresses the intent that Cash Reserves over
and above normal annual budgeted anticipated claims and
operating expenses shall be accumulated for the purposes
of such property and liability risk~ and
WHEREAS, the City Council of the City of Plainview,
Texas hereby expresses the intent that the City, over a
period of years, shall accumulate at least $2,000,000.00
for such Cash Reserves and continue to maintain that
amount each year through contributions from the City's
Operating Funds as necessary.
NOW, THEREFORE, BE IT ORDAINED by the City Council of
the City of Plainview, Texas:
SECTION 1.
The Self-Insurance Fund, a Trust
Fund for self-insurance, 'is hereby
established to provide coverage
for property and liability risk.
No part of said Fund shall be
expended for any purposes other
than the liability of the City of
Plainview, Texas, its officers,
agents and employees.
SECTION 2.
Each Operating Fund shall pay into
the Insurance Funds an annual
amount to be determined by the
City Council through preparation of the
Budget.
SECTION 3.
The City Manager is hereby
authorized to establish administrative
procedures for the settlement and
payment of claims up to $5,000.00 per
claimant. Proposed settlements of
claims exceeding $5,000.00 per claimant
shall be submitted to the City Council
for approval upon the recommendation of
the City Manager.
