HomeMy WebLinkAbout91-2868FRANCHISE PLAINVIEW AMBULANCE SERVICE 1 of 2 ORDINANCE NO. 91-2868 AN ORDINANCE AMENDING ORDINANCE NO. 88-2750 GRANTING A FRANCHISE TO PLAINVIEW AMBULANCE SERVICE; ALLOWING THE FRANCHISE 88-2750 TO BE RENEWED ANNUALLY. WHEREAS, the City of Plainview, Texas has provided for private transfer ambulance services to exist within the corporate limits of the City of Plainview by Ordinance No. 88-2738; and WHEREAS, Plainview Ambulance Service has submitted an application in accordance with the terms of Ordinance No. 88-2738 for a private, non-emergency, transfer ambulance service; and WHEREAS, the City Council of the City of Plainview held a public hearing on March 22, 1988, in compliance with Section 4-12 of Ordinance No. 88-2738, to determine the public convenience and necessity justifying the granting of a franchise, determining whether the applicant is qualified to render good service and whether the applicant has or will have sufficient equipment; and WHEREAS, the City Council of the City of Plainview has found sufficient and justifiable public convenience and necessity for the granting of a non-exclusive, non-emergency transfer ambulance service to Plainview Ambulance Service within the City of Plainview by Ordinance No. 88-2750, granted on April 26, 1988; and WHEREAS, Ordinance No. 88-2738 further provides that any changes or revisions to such franchise shall be accomplished after notice and a public hearing before the City Council; and WHEREAS, said notice and public hearing in accordance with the provisions of Ordinance No. 88-2738 have been accomplished. NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Plainview, Texas that: Section 1: That Section 7 of Ordinance No. 88-2750 is hereby amended to read as follows: The term of the franchise granted by this ordinance shall be renewable annually. Said term is subject to the provisions of Ordinance No. 88-2738. 29 3 Section 2: To the extent that the provisions of any existing City ordinance or ordinances are inconsistent with the provisions of this ordinance, such inconsistent provisions are hereby amended to conform. herewith.
