AN ORDINANCE OF THE CITY OF PLAINVIEW, TEXAS,
AMENDING THE PLAINVIEW CITY CODE.,. CHAPTER 23,
ARTICLE XI, ENTITLE :"TRAFFIC -CONTROL SIGNS,
SIGNALS AND DEVICES".
Whereas, the Traffic Code of the City of Plainview has. not been amended
since 1989 ; and
Whereas, the .City of Plainview recognizes a need to update the Traffic Code
to conform to existing conditions.
Now, therefore, be it ordafned by the City Council of the City of Plainview,
that Chapter 23, Article XI of .the Plainview City Code. is hereby amended to
read as' follows:
Section 1
DIVISION 1.
IN GENERAL
Sec. 23-105. General powers, duties of director of public safety and director
of public works .

The director of public safety shall determine. and establish the location of ~~
signals and devices when and as required under this chapter to make
effective the provisions of this chapter and such other traffic-control .devices
as he may deem necessary to regulate traffic under this chapter or state law,
or to guide or warn traffic, and shall inform the director of public works of
such determinations .
The director of public works shall direct the appropriate department to place
and maintain such traffic-control signs, .signals and devices at locations.
.established by the director of public safety.
Sec. 23-219.. Traffic lanes.
(a) The director- of public works is hereby authorized to direct the'
marking of traffic lanes, as determined and established. by the director of
public safety, upon. the. roadway of any street or highway where a regular
alignment. of traffic is necessary.
(b) Where such traffic lanes have been marked, it shall be unlawful
for the .operator. of any. vehicle to fail or refuse to keep such vehicle within
the boundaries of any such lane except when lawfully passing another vehicle
or preparatory to making a lawful. turning movement.
:Sec. 23-220. No-passing zones..
The .director of public safety is hereby authorized to determine those
portions of any street or highway in the city where .overtaking and passing

may inform the director of public work$ of such determination. The. director ~ ,,
of public works shall then direct the indication of the beginning :and ending

of such zones by use of appropriate signs or markings on the roadway.
~` ,~ When such signs or markings: are in place and clearly visible to any ordinarily
observant person, every driver of a vehicle shall obey the directions thereof .
.Seca 23-221. Turning markers.
(a) 'The .director of public safety is hereby authorized to determine
.and inform the director of public works, of locations for the placement of
markers, buttons or signs. within or adjacent to intersections indicating the
course to be traveled by vehicles turning at such intersections, .and such
course to be traveled as so indicated may conform to or' be other than as is
prescribed by laver or this.. chapter. The director of public works shall then
direct the installation of .such markers, buttons or signs as so indicated by
the director of public safety.
(b) When authorized .markers, buttons or other indications are placed
within an intersection indicating the` course to be traveled by vehicles turning
thereat, no .driver of a vehicle shall disobey the directions o£ such
indications .
Sec. 23-222. Restricted turn ~,ns.
The director of public safety is hereby authorized to determine those
intersections at which .drivers of vehicles shall -not make a right, left or
u-turn, and inform. the director of public works of such determination. The
director of public works shall then direct the placement of proper signs at
such intersections. The making of such turns may be prohibited between
certain hours of 'any day and .permitted at other hours, in tivhich event the
same shall be plainly indicated on the signs or they may be removed when
~ - ~ such turns are permitted.

DIVISION 2.
STOP, YIELD INTERSECTIONS
Sec. 23-232. Signals .required at through streets.
Whenever the director of public safety .designates and describes a
through street, he shall determine the type of signs or traffic control signals
which should' be installed and determine the location thereof . When notified
of such determinations, the director of public works shall. direct the
installation and maintenance: of such signs or traffic control signals . Stop
signs, or on the basis' of an engineering and traffic investigation at any
intersection, a yield sign, should be installed on each and every street
intersection such through. street unless traffic at any such intersection is
controlled at all dimes by traffic control signals; provided, however, .that at
the intersection: of two (2) such through streets or at the intersection of a
through street and a heavy traffic street not so designated, stop signs shall
be erected at the approaches of either of such streets- as may be; determined
by the .director of public safety upon 'the basis of an engineering and traffic
study.
Sec.23-233. Other intersections where. stop orVield required.
The director of public safety is hereby authorized to determine and
designated intersections .where particular hazard exists upon other than
.through streets and to determine whether vehicles shall. stop at one or more
entrances to any such intersection, in .which event he shall so inform the
~ - director of public works who shall direct. the erection of a estop sign _at every
such place where a stop is required. The director of public safety is further

authorized to determine and designate ,whether .vehicles shall yield the
right-of-way to Vehicles on a different. street at such intersection prescribed
in subsection (a) of section 23-234, in which event he shall so notify, ahe
director of public works who shall direct the erection of a yield sign at every
place where obedience thereto is required.
..DIVISION 3.
ONE-WAY-: STREETS, ALLEYS.
Sec. 23-243..: Designation.
Whenever any ordinance of .the designates any one-way street or alley,
the director of public works shall direct he placement and maintenance of
signs .giving: notice thereof,. and no such regulations :shall be effective unless
such signs are in place. Signs indicating the direction of lawful traffic
movement shall be placed at every intersection where movement of traffic. on
the.. opposite direction is prohibited.
Sec.23-245. Restriction of direction of traffic during certain periods.
(a) The director of public safety is hereby authorized to determine
and designate: streets,.... parts of streets or ,specific lanes thereon upon 'which
vehicular traffic shall, proceed in one direction: during one period and the
apposite. direction during another. period of the day and shall sa notify.. the
director of public works who shall direct he placement. and .maintenance of
appropriate markings, ,signs, barriers 'or other devices to give notice thereof.
The director of public safety may determine the need for traffic to
temporarily ..move in a .particular direction, regardless of the center line of the
roadway and shall so notify the director` of public. works who shall then direct..
the erection of markings, signs, .barriers. or other traffic control. devices to
so direct the movement of the traffic'..
(b) It shall. be unlawful .for. .any person to operate any. vehicle in
violation of such .markings,. signs,` barriers or other devices so placed in
accordance with the provisions. of this section.
Sec. 23-246. Standing. or parking.
(a) The director of public safety is authorized to determine the need
and location for the erection of signs' upon the left-hand- side of any one-way
street to prohibit the .standing or :parking bf vehicles, and when so notified,.
the director of public works shall direct the installation of such signs at .the
designated locations . When such signs are in place, no person shall stand or
park a vehicle upon. the left-hand. side; in .violation of any such.. sign..
(b } In the ..event a highway includes two (2) or mare separate
roadways and araffic is restricted to one direction upon any such roadway, no
person shall stand or park a vehicle upon the left-hand side of .such. roadway
unless signs are erected to permit -such standing or parking. .The director'. of
public safety is authorized to, determine when standing .or parking .may be
permitted on the left-hand side of any- -such one-way roadway and may so
inform. the director of public works -who shall direct the erection of signs
giving notice thereof .

Seca 23-356. Parking spaces.

The director of public works is hereby `authorized and. directed to cause
lines or markings to be painted upon the street adjacent to the ..curb for the
purpose of designating the parking .space to be used by :the vehicles parking
on or alon .the street so marked and each vehicle shall
g , .park within. the lines
or markings so established. It shall be unlawful :for any person to park any
vehicle. across any such line or marking or to .park. said vehicle in such a
position that .the same .shall. not be entirely. within the area so designated by
such lines or markings..
Sec. 23-361. Prohibited on narrow streets.
The director of public works is hereby authorized to cause to be
erected signs indicating no parking upon any street when the -width of the'
roadway does not exceed twenty (20} feet, or upon one side of a street as
indicated by such signs when the width of the roadway does -not .exceed
thirty (30) ..feet. When official signs prohibiting .parking are erected upon
narrow streets as authorized herein, no "person shall park a vehicle upon any
such street in violation of any such sign
Sec. 23-362. No stopping, standing or parking near hazardous. or congested
lap ces
(a) The director of public safety is hereby authorized to determine
places not exceeding one hundred (100) feet in length. in' .which stopping,
standing or parking vehicles would create an .especially .hazardous condition or
would cause unusual delay in traffic and the locations of signs for such
designation and shall so inform the director of public works who shall then
director thee. placement of such .signs.

authorized herein, no person shall stop., stand or park a vehicle in any such
designated place ...
DIVISION 5.
LOADING AND UNLOADTNG
Sec. 23-386.. Designation of zones.
-The director of public safety is hereby authorized to determine and so
inform the director of .public works of the location of passenger and freight
loading zones . The director of public works shall then direct the placement
and maintenance of appropriate signs indicating the same and stating the
hours during .which the provisions of .this section .are applicable.
Sec. 230387. Permits.
(a) The director of public safety shall not hereafter designate or
assign any zone as curb loading zone or as a freight curb Loading zone upon
special request of .any person unless such person makes application for a
permit .for .such zone. and for two (2) signs. to indicate the ends of each such
zone. The director of public safety., .when .granting a permit and issuing
such signs, shall take from the applicant or applicants an application .giving
such information as may be necessary to .determine the need for such permit
and the applicant shall be required to agree in writing to abide by the terms
and provisions of this .division. Every such permit shall .expire at the end of
one { 1) year .unless renewed on application of an applicant therefor.
~ (b) Nothing:. in this section shall be construed as giving.. the person
`~ --~ who makes .application for a loading zone of any kind as having any more
rights or privileges for the use of such zone than has the .general public or

! any ..other. person; nor shall the person or persons awning. the property,
building, or business in front of which a loading zone is located, ..:have any
more rights or privileges in the use. of such . loading zone than the general ~~~!
public. The use of such loading zone:, by ;all persons shall be in accordance. '~ °'
with the:.. provisions of this 'division..
Sec. 23-390. Desi~naton of public carrier sto ps--and stands.
The director of public .safety is hereby authorized and required. to
establish .bus stops, bus stands, taxicab stands and stands .for other
passenger common-carrier motor vehicles on such: public streets- in such places
and in such number as he shall. determine to be of the greatest benefit and
convenience to the public and .shall sa notify the director _of public works of
such determinations . :The director of public works shall direct that every.
such bus stop, bus stand, .taxicab :stand, or other stand be designated by
appropriate signs,.
Section 2 : Conflicts .
All ordinances or .portions of any ,ordinance of the City of Plainview,. Texas in
conflict herewith, are hereby amended to conform ~cvith `the provisions hereof
Section 3 : Penalties .
Any person who shall .violate or fail to comply .with any of the provisions of
this ordinance shall be deemed guilty of a misdemeanor and upon ..conviction
shall be punished by a fine as set forth in Section 1-5, ,Plainview City Code,
pursuant to law.

Section 4: Severability.
If any section, subsection, sentence, clause, phrase,. or portion of this
ordinance is for any reason; held invalid or unconstitutional by any court of
competent jurisdiction, such portion shall be deemed. a separate, distinct and
independent provision and such holding shall. not affect the validity of the
remaining portions .hereof .
