HomeMy WebLinkAboutOrd No. 11-3546CIVIL SERVICE CLASSIFICATION CAPTAIN ORDINANCE NO. 11 -3546 AN ORDINANCE OF THE CITY OF PLAINVIEW, TEXAS AMENDING CHAPTER 11, FIRE PROTECTION AND PREVENTION, OF THE CITY OF PLAINVIEW CODE OF ORDINANCES ESTABLISHING ONE ADDITIONAL POSITION IN THE CAPTAIN CLASSIFICATION AND TO ELIMINATE ONE POSITION IN THE EQUIPMENT OPERATOR CLASSIFICATION; PROVIDING FOR AN INCREASE IN THE NUMBER OF PERSONNEL IN THE CAPTAIN CLASSIFICATION; AND REMOVING ASSIGNMENT PAY FROM THE FIRE TRAINING DIVISION; SEVERABILITY CLAUSE; CUMULATIVENESS CLAUSE; CONFLICTS CLAUSE; REPEALER; AND EFFECTIVE DATE. WHEREAS, on May 5, 1990, the City of Plainview held a referendum to determine whether state civil service should be adopted for the City of Plainview Fire Department, and the results of the referendum were to adopt state civil service law for the Plainview Fire Department effective November 1, 1990; and WHEREAS, pursuant to Ordinance No. 90 -2841, a classification system for the City of Plainview Fire Department was established and later amended by Ordinance No. 91 -2855; Ordinance No. 91 -2857; Ordinance No. 93 -2965; Ordinance No. 03 -3382; and Ordinance No. 10 -3538; and WHEREAS, the proposed Ordinance has been duly presented to the Civil Service Commission for its recommendation, and they found in favor of the additional position in the Captain's Classification and elimination of one position in the Equipment Operator Classification; and WHEREAS, in an effort to effect an economy in operations and a betterment in municipal services, the City Council finds it to be in the best interests of the City to further amend the classification of fire personnel by establishing one additional position in the Captain classification with its attendant duties, and by eliminating one position in the equipment operator classification. NOW, THEREFORE, the City of Plainview hereby ordains that: SECTION I Chapter 11, Fire Protection and Prevention, is amended as follows: Sec. 11 -8. Classification of firefighters under civil service. The classification of all firefighters subject to state civil service law and the number of authorized positions in each classification are hereby provided as follows: Ordinance No. 11 -3546 Civil Service Classification- Captain Page 1 of 4 103 104 Classification No. of Authorized Positions Fire Chief (non -civil service position) 1 Fire Marshal 1 Captain 3- 4 Lieutenant 6 Equipment Operator X12 Firefighter 12 Total 36 Sec. 11 -13. Additional Pay. Additional pay is authorized in the following monthly amounts: (1) Certification Pay shall be authorized for the following additional amounts paid: Ordinance No. 11 -3546 (a) Firefighter Certification Pay: 1. Basic Firefighter Certification 2. Intermediate Firefighter Certification 3. Advanced Firefighter Certification (b) EMS Certification Pay: 1. Basic EMT 2. EMT -I 3. EMT -P or LP 40.00 $120.00 $220.00 40.00 $200.00 $400.00 (c) Paramedic Recertification Pay. A Paramedic is required to be recertified once every four years. For each time a Paramedic is recertified as a Paramedic while employed by the City of Plainview, the employed Paramedic will be paid $25.00 per month. (2) Assignment Pay shall be authorized for the following additional amounts paid: (a) Fire Prevention Division 1. Arson Investigator 11 2. Arson Investigator III 3. Fire Inspector 11 4. If any provision, including any section, paragraph, sentence, clause, phrase or word or the application thereof to any person or circumstance is held invalid, unconstitutional, or unenforceable by a court of law or administrative agency with jurisdiction over the matter, such action shall not be construed to affect any other valid portion of this Ordinance. A constitutional construction hereof is intended and shall be given. There is not intent herein to violate either of the Texas Constitution or the Constitution of the United States. SECTION III Provisions of this ordinance are cumulative and nothing herein shall prevent, alter, or diminish the applicability or enforcement of other ordinances restricting, regulating or governing the subject matter herein. SECTION IV All ordinances or portions of any ordinance of the City of Plainview, Texas in conflict herewith, are hereby amended to conform with the provisions hereof. SECTION V All ordinances or parts of ordinances inconsistent with any provisions of this Ordinance are hereby repealed to the extent of such conflict, and the provisions of this Ordinance shall be and remain controlling as to the matters regulated herein. SECTION VI This ordinance shall be of full force and effect upon its passage and publication as required by law. PASSED AND APPROVED on first reading this 9 day of June, 2011.
