ORDINANCE NO. 11 -3556
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PLAINVIEW,
TEXAS ADOPTING SHORTENED TIME FRAMES PURSUANT TO THE CITY
OF PLAINVIEW CHARTER FOR USE IN THE REDISTRICTING 2011
PROCESS; PROVIDING AN EFFECTIVE DATE; AND PROVIDING FOR
PUBLICATION.
WHEREAS, the City Council has certain responsibilities for redistricting under
federal and state law, including but not limited to, Amendments 14 and 15 to the United
States Constitution, U.S.C.A. (West 2006), and the Voting Rights Act, 42 U.S.C.A.
1973 and 1973c (West 2010); and Tex. Gov't Code Ann. 2058.001 and 2058.002
(Vernon 2008); and
WHEREAS, the City Council has certain responsibilities for redistricting under the
City Charter; and
WHEREAS, on review of the 2010 Census data, it appears that a population
imbalance exists requiring redistricting of the City's councilmember districts; and
WHEREAS, it is the intent of the City to comply with the City of Plainview Charter
in this redistricting process; and
WHEREAS, the population figures were not available at least one year and five
months before the first general election following the decennial census in accordance
with the time frame set forth in the City Charter; and
WHEREAS, pursuant to the City Charter, Section 6.02(c)(6), the redistricting time
frames set out in City Charter, Sections 6.02(c)(2), (3), and (4) must be shortened; and
WHEREAS, redistricting time lines will assist the City in its efforts to comply with
all applicable federal and state laws.
SECTION I
NOW, THEREFORE, The City of Plainview hereby ordains that:
The City of Plainview. Texas, in its adoption of a redistricting plan for city
councilmember districts, hereby adopts the following shortened time line in accordance
with the City Charter, Section 6.02(c)(6):
1. The period of time selected by the City Charter, Section 6.02(c)(2), for the
public to inspect and comment on the designated plan shall be shortened
from one month to three weeks;

SECTION II
The City Council will review all plans in light of these shortened time frames
adopted pursuant to the City Charter, Section 6.02(c)(6).
SECTION III

2. The time period for the Redistricting Commission to submit its plan to the City
Council designated by the City Charter, Section 6.02(c)(3), will be shortened
from not less than one year before the first general election of the City
Council after the decennial census to not less than eight (8) months before
the first general election of the City Council after the decennial census; and
3. The time that the City Council has to act on the Redistricting Commission's
recommendation will be shortened from the three weeks designated in the
City Charter, Section 6.02(c)(4), to five days.
This Ordinance shall be of full force and effect upon its passage and publication
as required by law.
