A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLAINVIEW,
TEXAS, APPROVING THE REQUESTS OF THE PLAINVIEW HERALD
AND THE PLAINVIEW CHAMBER OF COMMERCE; AUTHORIZING
THE FILING OF THE AGREEMENT FOR THE TEMPORARY CLOSURE
OF STATE RIGHT -OF -WAY WITH THE TEXAS DEPARTMENT OF
TRANSPORTATION FOR THE COWBOY DAY'S ANNUAL PARADE,
THE "HALE ON WHEELS" BICYCLE RIDE AND THE "HALE ON FEET"
5K RUN; DECLARING THAT THE EVENTS SERVE A PUBLIC
PURPOSE; AND AGREEING TO COMPLY WITH REGULATIONS.
WHEREAS, the City of Plainview has received a request from the Plainview
Herald on April 27, 2011 for the Cowboy Days Parade to be held on Saturday,
September 17, 2011; and
WHEREAS, the City of Plainview has also received a request from the Chamber
of Commerce on July 11, 2011 for the "Hale on Wheels" Bike Race and the "Hale on
Feet" 5K Run to be held in conjunction with the Cowboys Day Parade; and
WHEREAS, the Texas Department of Transportation owns and operates U. S.
Highway 70, Business Loop 1 -27 (Columbia St.), Spur 445, Southeast 4th (FM 3466),
and FM 400 in the corporate limits of the City of Plainview; and
WHEREAS, the U. S. Highway 70 crosses Broadway Street within the corporate
limits of the City of Plainview; and
WHEREAS, the intersection of U.S. Highway 70 and Broadway Street is the
critical vein for parade use; and
WHEREAS, the "Hale on Wheels" Bicycle Race will start at 8:30 a.m. at the 011ie
Liner Center and will follow a route on the following State owned and operated streets:
Beginning the race at Spur 445, traveling east to Broadway Street, turning north on S.
Broadway, then right off S. Broadway onto S.E. 4 th Street, then traveling eastward to FM
400 where the riders will go south until the exit the corporate limits of the City of
Plainview. The bike riders will return to the City on Business 1 -27 from the south and exit
onto Spur 445 and end on the south side of the 011ie Liner Center; and
WHEREAS, beginning at 9:00 a.m., the "Hale on Feet" 5k Run will start at the
011ie Liner Center at Spur 445. The runners will cross South Columbia Street, then turn
left and take the curve to continue on S. Broadway, crossing S.E. 4 th Street. From there
they will turn right onto East 2nd Street, then right on S. Ash Street for .20 miles, then
right on S.W. 1 St Street for .10 miles. At that point, they will turn left on S. Broadway,
crossing S.E. 4 th Street, then turn right on S.W. 20 and return to the Start /Finish Line;
and

WHEREAS, the Cowboy's Day Parade will begin at 10:30 a.m. on North
Broadway at the Santa Fe Depot, going south and crossing Hwy 70, then concluding at
Broadway Park; and
WHEREAS, the City Council of the City of Plainview finds that such events serve
a public purpose in that the parade celebrates Hale County's heritage; and
WHEREAS, the City Council of the City of Plainview, Texas finds it in the best
interest for the citizens of Plainview that the Annual Cowboy Day's Celebration be held
this year on September 17, 2011 and use the above stated routes for each respective
event; and
WHEREAS, the Texas Department of Transportation requires the Local
Government to submit a completed Agreement for the Temporary Closure of State
Right of Way for use of U.S. Highway 70, Business Loop 1 -27 and Spur 445, S.E. 4th
and FM 400 in such public events as a parade, bike ride, and 5k run; and
WHEREAS, the City Council designates Mayor John C. Anderson as the City's
authorized official. The authorized official is given the power to apply for or terminate
such Agreement on behalf of the City.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PLAINVIEW THAT:
The request from the Plainview Herald to host the Annual Cowboy Day's Parade
for September 17, 2011 is hereby approved.
The requests from the Plainview Chamber of Commerce to sponsor the "Hale on
Wheels" Bicycle Race and the "Hale on Feet" 5k Run in conjunction with Cowboy Days
is hereby approved for September 17, 2011; and
III.
The public purpose of these events is to celebrate Hale County's heritage.
IV.
Submission of the completed AGREEMENT FOR THE TEMPORARY CLOSURE
OF STATE RIGHT -OF -WAY with the Texas Department of Transportation is hereby
approved.

The Mayor is hereby authorized and directed to execute, respectively, on behalf
of the City of Plainview, all necessary documents, including the AGREEMENT FOR
THE TEMPORARY CLOSURE OF STATE RIGHT -OF -WAY, to complete the parade,
bike ride and 5kRun preparation processes.
