ORDINANCE NO. 11 -3559
AN ORDINANCE OF THE CITY OF PLAINVIEW, TEXAS, ADOPTING A
NEW REDISTRICTING PLAN THEREBY REVISING CITY COUNCIL
MEMBER DISTRICT BOUNDARIES IN RESPONSE TO THE 2010
CENSUS, PROVIDING FOR THE FOLLOWING: FINDINGS OF FACT;
ADOPTION OF A PLAN; ELECTION PRECINCTS; SEVERABILITY
CLAUSE; CUMULATIVENESS CLAUSE; CONFLICTS CLAUSE; AN
EFFECTIVE DATE; AND PROPER NOTICE AND MEETING
PUBLICATION.
WHEREAS, the City Council has certain responsibilities for redistricting under
Federal and state law including but not limited to Amendments 14 and 15 to the United
States Constitution, U.S.C.A. (West 2006), and the Voting Rights Act, 42 U.S.C.A.
1973 and 1973c (West 2010); and Tex. Gov't Code Ann. 2058.001 and 2058.002
(Vernon 2008); and
WHEREAS, the City Council has certain responsibilities for redistricting under the
City Charter; and
WHEREAS, the 2010 decennial census disclosed that existing council districts in
the City of Plainview, Texas, are substantially unequal in population; and
WHEREAS, pursuant to City of Plainview City Charter Section 6.02, a
Redistricting Commission consisting of nine members was appointed by City Council;
and
WHEREAS, pursuant to City of Plainview City Charter Section 6.02, the
Redistricting Commission has undertaken to redraw the seven (7) council districts for
the convenience of the people and to equalize population and assure compliance with
the applicable requirements of state and federal law; and
WHEREAS, pursuant to City of Plainview City Charter Section 6.02, in a duly
publicized public hearing, the Redistricting Commission has received and considered
oral testimony and written evidence regarding the need for new council districts and an
appropriate configuration of these districts; and
WHEREAS, pursuant to City of Plainview City Charter Section 6.02, the
Redistricting Commission has recommended to the City Council the adoption of the
plan, "Illustrative Plan 1" that was presented to the public at the public hearing; and
WHEREAS, the City Council finds that the attached maps of the new districts
reflect the division of the City of Plainview into seven (7) districts which satisfy all legal
requirements, including the U.S. and Texas Constitutions and Statutes and the Federal
Voting Rights Act and the City Charter.

NOW, THEREFORE, The City of Plainview hereby ordains that:
SECTION I FINDINGS OF FACT
All of the above premises are hereby found to be true and correct legislative and
factual findings of the City of Plainview and are hereby approved and incorporated into
the body of this ordinance as if copied in their entirety.
SECTION II ADOPTION OF PLAN
The boundaries of the seven (7) single- member council districts are hereby
modified, amended, and redrawn for the purposes of apportioning the population of the
City between the council districts, and as modified, amended and redrawn, the
boundaries of the seven (7) Councilmember districts shall be in accordance with the
map attached hereto as Exhibit "A" and the demographic information attached hereto as
Exhibit "B which map and charts are incorporated by reference into and made a part of
this ordinance.
SECTION III ELECTION PRECINCTS
The City Secretary is hereby instructed to send a copy of this ordinance and the
new district map and other descriptions to the proper officials of Hale County so the
County can make the necessary changes in the County's election precincts, as required
by the Texas Election Code.
SECTION IV SEVERABILITY CLAUSE
Severability is intended throughout and within this Article. If any provision,
including any section, paragraph, sentence, clause, phrase or word or the application
thereof to any person or circumstance is held invalid, unconstitutional, or unenforceable
by a court of law or administrative agency with jurisdiction over the matter, such action
shall not be construed to affect any other valid portion of this Ordinance. A
constitutional construction hereof is intended and shall be given. There is no intent
herein to violate either of the Texas Constitution or the Constitution of the United States.
SECTION V CUMULATIVENESS CLAUSE
Provisions of this Ordinance are cumulative and nothing herein shall prevent,
alter, or diminish the applicability or enforcement of other ordinances restricting,
regulating, or governing the subject matter herein.
SECTION VI CONFLICTS CLAUSE
All ordinances or portions of any ordinance of the City of Plainview, Texas in
conflict herewith, are hereby amended to conform with the provisions hereof.

SECTION VII EFFECTIVE DATE
This ordinance shall be in full force and effect upon its passage and publication
as required by law and after preclearance by the U.S. Department of Justice, as may be
required by governing law.
SECTION VIII PROPER NOTICE AND MEETING
It is hereby officially found and determined that the meeting at which this ordinance was
passed was open to the public as required and that public notice of the time, place and
purpose of said meeting was given as required by the Open Meetings Act, Chapter 551
of the Texas Government Code.
