HomeMy WebLinkAbout08.26.2002 BA MinutesBOARD OF ADJUSTMENT MINUTES 8-26-02 BOARD MEMBERS PRESENT: Ray Jameson, Fred Willis, Jennifer Wright, Armro Ortiz STAFF MEMBERS PRESENT: John Castro, Director of Community Services, Audra Ramos Community Development Secretary OTHER GUESTS PRESENT: Mark & Elida Rangel, Roger & Sue Ritesman, Sandra Mogg, Julian Gallardo, Lesal McNutt First item on the agenda: Approval of July 2002 minutes. Fred Willis made motion to approve minutes. Arturo Ortiz seconded the motion. Motion carried 4-0. Second item on the agenda: The request of Roger and Sue Ritesman for a variance of six (6) feet of the required eight (8) foot side setback and sixteen (16) feet of the required thirty-five (35) foot front setback as stated in Section 34 of the City of Plainview Zoning Ordinance to construct a 21' X 24' carport with a twelve (12) foot extension along the north side of the structure in a Single-family Residential (R-l) Zoning District, and being Block 2, Lot 4, Phenix Addition, Plainview, Hale County, Texas the same being 805 Yonkers Street. Roger Ritesman is present. He said he had visited with his neighbors about his proposed carport and they had no problems with it. John Castro showed pictures of the property and the proposed placement of the carport. He said if Mr. Ritesman is granted a variance of 6 (six), it would leave the carport 2 (two) feet off the property line on the side. On the front, he needs a variance of 16 (sixteen) feet because of the cut-away portion of the house. There were no responses received from the neighborhood. Jennifer Wright asked what the carport would be constructed of? Mr. Ritesman said it would probably be made of steel and wood, trying to match the appearance of the house. Mr. Ritesman told the Bard he is a builder, more familiar at working with wood, but the carport would most likely have steel posts with the top and sides constructed of wood and the roof would have shingles to match the house. Jennifer Wright made motion to approve the variance based on this being the only logical place for the carport. Fred Willis seconded the motion. Motion carried 4-0. Third item on the agenda: The request of Julian and Nicolasa Gallardo for a variance of two (2) feet five (5) inches of the required five (5) foot side setback and eleven (11) feet six (6) inches of the required twenty-five (25) foot front setback as stated in Section 34 of the City of Plainview Zoning Ordinance to construct a 12' X 20' carport in a Single-family Residential (R-2) Zoning District, and being Block 2, Lot S37'-4 N13'-5, Gardenville Addition, Plainview, Hale County, Texas the same being 2507 Rochelle Street. Julian Gallardo is present. Audra Ramos will interpret for Mr. Gallardo. John Castro showed the Board pictures of the property with the proposed carport. If the variance is granted, the carport will be two (2) feet five (5) inches from the property line. John Castro told the Board they have granted variances in this area in the past. There were two (2) responses in favor of the variance received from the neighborhood. Arturo Ortiz asked what construction materials would be used for the carport. Mr. Gallardo's response was steel. Fred Willis made motion to approve the variance based on other carports in the area, lack of negative response from neighbors, and this being the only logical place for the carport. Arturo Ortiz seconded the motion. Motion carried 4-0. Fourth item on the agenda: The request of Mark Rangel for a variance of three (3) feet of the required five (5) foot side setback and twenty-three (23) of the required twenty-five (25) foot front setback as stated in Section 34 of the City of Plainview Zoning Ordinance to construct a 13' 6"X 23' carport with a 5'6" X 6' extension to run along the from of the structure as part of the carport in a Single-family Residential (R-2) Zoning District, and being Block 5, Lot W50'-16, Gardenville Addition, Plainview, Hale County, Texas the same being 2102 W. 26th Street. Mark Rangel is present. John Castro showed the Board pictures of the property and a site plan showing the proposed carport. There was one (1) favorable response received from the neighborhood. Jennifer Wright made motion to approve the variance due to this being the most logical place for the carport. Fred Willis seconded the motion. Motion carded 4-0. Fifth item on the agenda: The request of Sandra Roberson Mogg for a variance of nine (9) feet of the required thirty-five (35) foot front setback as stated in Section 34 of the City of Plainview Zoning Ordinance to construct a 18'X 21' carport in a Single-family Residential (R-2) Zoning District, and being Block 2, Lots 1-2, Eoff-Green Addition, Plainview, Hale County, Texas the same being 1400 S. Broadway Street. Sandra Mogg is present. There was one (1) response received from the neighborhood in favor of the variance. Sandra Mogg told the Board the carport will have shingles matching the house and will also have the same green trim as the house. She said the carport will be anchored and of steel construction materials. She added that it is a ready-build carport. John Castro showed the Board photographs and a site plan of the property and proposed carport. He told the Board that Ms. Mogg had considered several different locations for the carport but each location would require a variance. Fred Willis made motion to approve the variance based on positive response from the neighborhood and this being the most logical place for the carport. Armro Ortiz seconded the motion.
