OTHER GUESTS PRESENT: Henry R. Pequeno, Regino Hernandez
First item on the agenda: Approval of April 2002 minutes. Max Browning made note of typographical
error in the second item on the agenda, the next to the last sentence: change "and the request (iJ) to (oJ)
only ten feet..." He then made motion to approve the minutes with the change. Fred Willis seconded the
motion. Motion carded 4-0.
Second item on the agenda: The request of Henry Pequeno for a variance of fifteen (15) feet of the
required twenty-five (25) foot front setback and five (5) feet of the required five (5) foot side setback as
stated in Section 34 of the City of Plainview Zoning Ordinance to construct a 21' X 25' carport in a
Single-family Residential (R-2) Zoning District, and being Block 20, Lot 23, Highland Addition,
Plainview, Hale County, Texas the same being 1908 Independence Street. Mr. Pequeno is present. John
Castro stated there are twenty-two (22) feet behind the curb to the property line and then thirty-five (35)
feet from the property line to the front of his house. The setback here is twenty-five (25) feet, which is
why he is asking for fifteen (15) feet of the required twenty-five (25) foot front setback and the entire side
setback. John Castro noted there is another carport a few houses down from this location. There were
three responses received, all in favor of the variance. Fred Willis asked if there would be a problem with
putting the carport right on the property line and John Castro stated not in this instance. Max Browning
inquired what material would be used in the construction of the carport. Mr. Pequeno stated it would be
made of four by four (4 X 4) metal tubing. Charlene Jones asked if the existing concrete slab would be
extended to the property line. Mr. Pequeno stated it would probably be extended at a later date. He stated
he is constructing the carport for his wife's protection from the elements since she uses a walker. Fred
Willis asked if the carport would cover the front door. Mr. Pequeno stated it would come to the edge of
the outside of the sidewalk. Charlene Jones made a motion to approve the variance based on this being
the only logical place for it. Max Browning seconded the motion. Motion carried 4-0.
